An Ordinance to amend the Court of Petty Sessions Ordinance 1930

Ordinance under the Seat of Government (Administration) Act 1910.

C O U R T OF PETTY SESSIONS ( A M E N D M E N T ) O R D I N A N C E

(No. 2) 1980

Short title

1. This Ordinance may be cited as the Court of Petty Sessions (Amend­

ment) Ordinance (No. 2) 1980.1

Principal Ordinance

Sessions Ordinance 1930.2	2. In this Ordinance, "Principal Ordinance" means the Court of Petty
section substituted:

3. Section 24B of the Principal Ordinance is amended—

(a)	by adding "and" at the end of sub-paragraph (a) (ii);
(b)	by omitting "and" from sub-paragraph (a) (iii); and

(c) by omitting sub-paragraph (a) (iv).

Copies of information, &c.

4. Section 144 of the Principal Ordinance is amended by omitting from sub-section (1) "the prescribed fee" and substituting "such fees as are prescribed".

5. Section 245 of the Principal Ordinance is repealed and the following

Court fees
"245. (1) Subject to this Ordinance and to any other law in force in the Territory, there are payable to the Clerk, in respect of proceedings and matters under this Ordinance, such fees as are prescribed by rules or regulations under this Ordinance.

"(2) Subject to sub-section (3), fees prescribed for the purpose of sub­

section (1) shall be paid in advance.
"(3) Sub-section (2) does not apply to a fee for the service or execution of process or for an attempt to serve or execute process where the amount of the fee is to be calculated by reference to the expenses actually incurred in such service or execution or in such attempt, as the case may be.".
