Court Fees Regulation Amendment Regulations 2024

Made by the Governor in Executive Council.

Part 1Preliminary1.Citation

These regulations are the Court Fees Regulation Amendment Regulations 2024.

2.Commencement

These regulations come into operation as follows —

  • (a)

    Part 1 — on the day on which these regulations are published on the WA legislation website;

  • (b)

    the rest of the regulations — on 1 September 2024.

Part 2Children’s Court (Fees) Regulations 2005 amended3.Regulations amended

This Part amends the Children’s Court (Fees) Regulations 2005.

4.Regulation 5 replaced

Delete regulation 5 and insert:

5. Exemptions

A person is not required to pay a fee in respect of the following —

  • (a)

    an application under the Restraining Orders Act 1997 for a family violence restraining order or violence restraining order or to vary or cancel a family violence restraining order or violence restraining order;

  • (b)

    an application under the Prohibited Behaviour Orders Act 2010 for a prohibited behaviour order or to vary or cancel a prohibited behaviour order;

  • (c)

    civil proceedings under the Criminal Law (Mental Impairment) Act 2023;

  • (d)

    a matter if —

    • (i)

      a written law provides that the person is not required to pay a fee in respect of a matter of that type; or

    • (ii)

      the person has not reached 18 years of age on the day the fee would otherwise be payable.

       
    Part 3District Court (Fees) Regulations 2002 amended
5.Regulations amended

This Part amends the District Court (Fees) Regulations 2002.

6.Regulation 5 amended
  • (1)

    In regulation 5(1):

    • (a)

      in paragraph (c) delete “order.” and insert:

       

    order; or

     
    • (b)

      after paragraph (c) insert:

       
    • (d)

      civil proceedings under the Criminal Law (Mental Impairment) Act 2023.

       
  • (2)

    In regulation 5(1) after each of paragraphs (a) and (b) insert:

Part 4Magistrates Court (Fees) Regulations 2005 amended7.Regulations amended

This Part amends the Magistrates Court (Fees) Regulations 2005.

8.Regulation 5 amended

In regulation 5(1):

  • (a)

    in paragraph (c) delete “order.” and insert:

     

order; or

 
  • (b)

    after paragraph (c) insert:

     
  • (d)

    civil proceedings under the Criminal Law (Mental Impairment) Act 2023, other than a fee referred to in Schedule 1 Division 1 item 8.

     
Part 5Supreme Court (Fees) Regulations 2002 amended9.Regulations amended

This Part amends the Supreme Court (Fees) Regulations 2002.

10.Regulation 5 amended

In regulation 5(2):

  • (a)

    in paragraph (j) delete “2006.” and insert:

  • (b)

    after paragraph (j) insert:

     
  • (k)

    civil proceedings under the Criminal Law (Mental Impairment) Act 2023.
