County Court (Chapter I Warrant of Seizure and Sale Amendment) Rules 2020

A majority of the Judges of the County Court makes the following Rules:

1Object

The object of these Rules is to amend Chapter I of the Rules of the County Court to update Form 68A, the form of warrant of seizure and sale, in relation to payment of interest.

2Authorising provisions

These Rules are made under section 78 of the County Court Act 1958 and all other enabling powers.

3Form 68A amended

In Form 68A of the County Court Civil Procedure Rules 2018[1]—

(a)after "taken in execution for" insert "the sum of";

(b)for paragraphs (a) to (d) substitute—

"(a)$       , being the amount now due and payable for which judgment was entered or given;

(b)$       , being the amount now due and payable in respect of costs;

(c)$       , being the amount due and payable for interest accrued in respect of the judgment amount and the amount of costs at the date of the issue of the warrant, at the rate fixed in accordance with law;

(d)$        , [insert amount of interest payable per day], being the amount of interest, if any, for each day which, subject to any future payment under the judgment, will accrue from the date of the issue of the warrant until the execution of the warrant; and".
