County Court Act 1958

County Court (Chapter I Miscellaneous Amendments) Rules 2019

A majority of the Judges of the County Court makes the following Rules:

Part 1—Preliminary

1Object

The object of these Rules is to amend Chapter I of the Rules of the County Court—

(a)to set out the proceedings of which the Confiscations List of the Common Law Division consists;

(b)to provide for an Adoptions, Surrogacy and Name Changes List of the Common Law Division; and

(b)to remove a redundant Form relating to subpoenas and to make a consequential amendment.

2Authorising provisions

These Rules are made under section 78 of the County Court Act 1958 and all other enabling powers.

3Commencement

These Rules come into operation on 1 May 2019.

4Principal Rules

In these Rules, the County Court Civil Procedure Rules 2018[1] are called the Principal Rules.

Part 2—Lists of the Common Law Division

5Common Law Division

In Rule 34A.03 of the Principal Rules—

(a)in paragraph (f), for "2013." substitute "2013;";

(b)after paragraph (f) insert—

"(g)any proceeding under—

(i)the Confiscation Act 1997; or

(ii)the Proceeds of Crime Act 2002 of the Commonwealth;

(h)any proceeding under—

(i)the Adoption Act 1984;

(ii)the Births, Deaths and Marriages Registration Act 1996; or

(iii)Part IV of the Status of Children Act 1974.".

6Lists of Common Law Division

(1)In Rule 34A.04(1) of the Principal Rules—

(a)in paragraph (f) omit "and";

(b)in paragraph (g), for "List." substitute "List; and";

(c)after paragraph (g) insert—

"(h)the Adoptions, Surrogacy and Name Changes List.".

(2)For Rule 34A.04(2) of the Principal Rules substitute—

"(2)The General List shall consist of any proceeding in the Common Law Division that is not in another List referred to in paragraph (1).".

(3)After Rule 34A.04(8) of the Principal Rules insert—

"(9)The Confiscations List shall consist of any proceeding referred to in Rule 34A.03(g).

(10)The Adoptions, Surrogacy and Name Changes List shall consist of any proceeding referred to in Rule 34A.03(h).".

Part 3—Subpoenas

7Rule 42A.03 substituted

For Rule 42A.03 of the Principal Rules substitute—

"42A.03   Form of subpoena

A subpoena under this Order shall be in Form 42AA.".

8Form 42AB revoked

Form 42AB of the Principal Rules is revoked.
