County Court (Chapter I Circuit Fees, Expenses and Allowances Amendment) Rules 2022

A majority of the Judges of the County Court makes the following Rules:

1Object

The object of these Rules is to amend Chapter I of the Rules of the County Court to provide for an increase to—

(a)the circuit fees in Schedule 1 to those Rules; and

(b)the witnesses' expenses and interpreters' allowances in Schedule 2 to those Rules.

2Authorising provisions

These Rules are made under section 78 of the County Court Act 1958 and all other enabling powers.

3Commencement

These Rules come into operation on 1 January 2023.

4Schedule 1 substituted

For Schedule 1 to the County Court Civil Procedure Rules 2018[1] substitute—

5Witnesses' expenses and interpreters' allowances

(1)In clause 1(1) of Schedule 2 to the County Court Civil Procedure Rules 2018—

(a)for "$203.00–$408.00" substitute

"$216.00–$433.00";

(b)for "$2535.00" substitute "$2690.00".

(2)In clause 1(2) of Schedule 2 to the County Court Civil Procedure Rules 2018, for "$421.00" substitute "$447.00".

(3)In clause 1(2) and (3) of Schedule 2 to the County Court Civil Procedure Rules 2018, for "$759.00" substitute "$805.00".

(4)In clause 1(3) of Schedule 2 to the County Court Civil Procedure Rules 2018, for "$125.00" substitute "$133.00".

(5)In clause 3(1) of Schedule 2 to the County Court Civil Procedure Rules 2018, for "$84.00" substitute "$89.00".

(6)In clause 3(1) and (2) of Schedule 2 to the County Court Civil Procedure Rules 2018—

(a)for "$60.00" substitute "$64.00";

(b)for "$367.00" substitute "$390.00".

(7)In clause 3(2) of Schedule 2 to the County Court Civil Procedure Rules 2018, for "$211.00" substitute "$223.00".
