County Court (Chapter I Amendment No. 7) Rules 2013

A majority of the Judges of the County Court makes the following Rules:

1Object

The object of these Rules is to amend Chapter I of the Rules of the County Court to—

(a)align certain provisions more closely with the practices of the Court in relation to interlocutory applications, powers of the Court and applications by summons;

(b)insert a note to clarify the application of the Electronic Transactions (Victoria) Act 2000 in respect of ordinary service effected electronically;

(c)require a legal practitioner to provide an email address under Rule 27.03(11)(b);

(d)revoke provisions relating to joint court books in certain proceedings.

2Authorising provisions

These Rules are made under section 78 of the County Court Act 1958 and all other enabling powers.

3Commencement

These Rules come into operation on 1 July 2013.

4Principal Rules

In these Rules, the County Court Civil Procedure Rules 2008[1] are called the Principal Rules.

5Interlocutory application

In Rule 4.02 of the Principal Rules, after "orders" insert "and subject to any practice note applying to a proceeding in a specialist list".

6How ordinary service effected

At the foot of Rule 6.07(1) of the Principal Rules insert

"Note

The Electronic Transactions (Victoria) Act 2000 applies to enable a document to be served electronically, including facsimile transmission and email, in accordance with that Act.".

7Form of document

In Rule 27.03(11)(b) of the Principal Rules omit "(if any)".

8Powers of Court

(1)In Rule 34.01(2) of the Principal Rules, for "A party" substitute "Subject to paragraph (3), a party".

(2)After Rule 34.01(2) of the Principal Rules insert

"(3)The requirement to file a summons does not apply in respect of an interlocutory application in a proceeding in a specialist list if a practice note applying in respect of proceedings in that list otherwise provides.".

9No trial without court book

At the foot of Rule 34A.27 of the Principal Rules insert

"Note

A practice note may make further provision with respect to the requirements and contents of a court book.".

10Case management—court book

Rules 34A.30 to 34A.35 of the Principal Rules are revoked.

11Application by summons

(1)For Rule 46.02(1) of the Principal Rules substitute

"(1)An application made on notice to any person shall be by summons, unless—

(a)the Court otherwise orders; or

(b)in the case of an interlocutory application in a proceeding in a specialist list, a practice note applying in respect of proceedings in that list otherwise provides.".

(2)After Rule 46.02(3) of the Principal Rules insert

"(4)Despite paragraph (3)—

(a)an application not by summons referred to in paragraph (1)(a) is made at the time specified in the order;

(b)an application not by summons referred to in paragraph (1)(b) is made in accordance with the practice note that applies.".
