County Court Act 1958
County Court (Chapter I Amendment No. 24) Rules 2008
A majority of the Judges of the County Court makes the following Rules:
1Objects
The objects of these Rules are—
(a)to make further provision relating to electronic filing; and
(b)to permit doubled-sided printing of documents.
2Authorising provisions
These Rules are made under section 78 of the County Court Act 1958 and all other enabling powers.
3Commencement
These Rules come into operation on 1 November 2008.
4Principal Rules
In these Rules, the County Court Rules of Procedure in Civil Proceedings 1999[1] are called the Principal Rules.
5How personal service effected
In Rule 6.03(2) of the Principal Rules—
(a)after "filed electronically" insert "in accordance with Part 2 of Order 28";
(b)omit "that has been sealed by the Registrar".
6Form of document
For Rule 27.03(2) of the Principal Rules substitute—
"(2)Subject to the Rules—
(a)a document may be printed single-sided or double-sided, but not partly single‑sided and partly double-sided;
(b)the sheets of a document shall be securely fastened—
(i)if the document is single-sided, at the top left hand corner;
(ii)if the document is double-sided, along the left hand side; and
(iii)without obscuring the writing or the margin;
(c)a left hand margin of at least 25 millimetres and a top margin of 30 millimetres shall be kept clear on each sheet of a document that bears writing;
(d)the pages of a document shall be consecutively numbered; and
(e)a document shall have double spacing between the lines.".
7Registrar may accept document for filing
(1)In Rule 28.11(1)(c) of the Principal Rules, for "that is" substitute "which, if filed personally would be".
(2)In Rule 28.11(2) of the Principal Rules for "be sealed with" substitute "contain a facsimile of".
8Form 28 amended
In Form 28 of the Principal Rules, for "[Court seal]" substitute "[facsimile of Court seal]".
