An Act to amend the Country Towns Police Act
as respects the al ignment of Streets. [7th September, 1855.]
WH E R E A S by the Ac t of Counci l passed in t h e second year of t h e re ign of H e r presen t Majes ty in t i tu led " An Act for
" regulating the Police in the Towns of Parramatta Windsor Mait-
" land Bathurst and other Towns respectively and for removing and
" preventing Nuisances and Obstructions and for the better alignment " of Streets therein " it was amongs t o ther th ings enacted t h a t t he Surveyor Genera l or some person deputed by h im should set ou t t h e b read th of t he carr iage a n d foot ways of the Towns in t h e said A c t specified and such o ther Towns as should be declared by H i s Exce l lency t h e Governor by Proc lamat ion to come u n d e r t h e opera t ion of t h a t A c t and should cause t h e footways to be m a r k e d by posts a t t he corners and intersect ions of t h e streets or wherever t he same may be necessary for defining the footways and tha t t he carr iage a n d foot ways when so set ou t should be deemed to be t h e carr iage and foot ways wi th in t he m e a n i n g of t he said Ac t and it was thereby fur ther enacted t h a t before t h e said Surveyor Genera l or person deputed by h i m should set out t h e foot way in any s t reet or p a r t of a s treet or publ ic place in any of t he said Towns he should lay before t h e Governor and Execu t ive Counci l a p lan of t he same se t t ing forth t he proposed b r ead th of the carr iage and foot ways a n d t h a t t he r eupon it should be lawful for t he said Governor a n d Counci l by not ice in t h e Government Gazette t o fix a n d declare t h e dis tances from t h e kerb-s tone or exterior edge of t h e said footway in any such s treet or pa r t of a s t reet or publ ic place wi th in which i t should no t be lawful to erect any bu i ld ing A n d whereas t h e said enac tmen t s cannot be ac ted u p o n wi thou t exact surveys a n d p lans involving grea t labor and expense which surveys a n d p lans may be dispensed wi th in the cases of m a n y Towns which have been laid out accura te ly and w i t h sufficient s t reets and in which a l lo tments have been sold a n d conveyed in conformity w i t h such l ay ing out a n d not otherwise Be i t t he re

fore enacted by H i s Excel lency t h e Governor of N e w South W a l e s by
and wi th t h e advice a n d consent of t h e Legis la t ive Council thereof as follows :— I n all Towns or par t s of Towns in which the s t reets shall have been set ou t and a l lo tments sold in conformity wi th t h e design of such Towns or pa r t s of Towns or in which s t reets shal l have been set ou t and a l lo tments sold in extens ion of such design it shal l be sufficient for the Surveyor Genera l or any person deputed by h i m or for any Magis t r a t e or Munic ipa l Officer of any such Town unde r t he au thor i ty of t h e Governor to set ou t and m a r k t h e carr iage a n d foot ways in t he s t reets lanes and publ ic places in such Towns or pa r t s of Towns by p lac ing posts a t the corners and in tersect ions of t he streets or wherever t h e same m a y be necessary or desirable so as to give a wid th of forty-two feet for t he carr iageway and twelve feet for t h e footway on each side
w h e n the streets shall be sixty-six feet wide and in propor t ion a n d in
the discret ion of t h e said Surveyor General or other officer as aforesaid in any streets lanes or publ ic places of o ther -widths t h a n sixty-six feet and t he r eupon such carr iage and foot ways respectively shall be deemed to be fully set out a n d m a r k e d for t h e purposes of t h e said Ac t a n d for all o ther purposes in t h e law whatsoever .
