HOSTELS AUTHORITY AMENDMENT ACT 1998

AN ACT to amend the Country High School Hostels

Authority Act 1960.

[Assented to 26 March 1998.]

The Parliament of Western Australia enacts as follows:

Short title

1.   This Act may be cited as the Country High School Hostels

Authority Amendment Act 1998.

Commencement

2. This Act comes into operation on the day on which it

receives the Royal Assent.

Principal Act

3. In this Act the Country High School Hostels Authority

Act 1960* is referred to as the principal Act.

Section 3 amended

4.   Section 3 of the principal Act is amended —

(a)

bydeletingthedefinitionsof‘‘highschool’’and ‘‘primary school’’;

(b)

in the definition of ‘‘hostel’’ by deleting ‘‘enrolled in a high school, or in a primary school’’;

(c)

byinsertingafterthedefinitionof‘‘hostel’’the following definition —

‘‘

‘‘isolated student’’ means a student —

(a)

who is geographically isolated for the purposes of the Assistance for Isolated Children Scheme referred to in the Student and Youth Assistance Act 1973 of the Commonwealth; or

(b)

whoseparents’principalhomeis isolated within the meaning of regulat ion 78 of the AUSTUDY R e g u l a t i o n s 1 9 9 1 o f t h e Commonwealth;

’’;

and

(d)

afterthedefinitionof‘‘member’’bydeletingthe semicolon and substituting a full stop.

Section 7 amended

5.

(1)

Section 7 (1) (a) of the principal Act is deleted and the

following paragraph is substituted —

‘‘

(a)

to provide, or cause to be provided, accommodation in hostels —

(i)

forisolatedstudentsenrolledinasecondary school established under the Education Act 1928; and

(ii)

subject to such conditions as the Minister may impose, for students of such other classes as are approved by the Minister;

’’.

(2)

Section 7 (1) (ba) (i) of the principal Act is amended by

inserting after ‘‘admission’’ the following —

‘‘ , subject to section 7A, ’’.

Section 7A inserted

6.   After section 7 of the principal Act the following section is

inserted —

‘‘

Priority

7A.

(1)

Places in a hostel shall be allotted to students in

the following order of priority —

(a)

students(whetherisolatedornot)whowere accommodated in the hostel during the previous school year;

(b)

isolated students who were not accommodated in the hostel during the previous school year; and

(c)

subject to subsection (2), students of all other classes.

The Minister may direct a hostel to allot places in that hostel to students referred to in subsection (1) (c) in such order of priority as the Minister thinks fit and effect is to be given to that direction.
