Regulations 1997
The Governor in Council makes the following Regulations:

1. Objective
The objective of these Regulations is to amend the
Country Fire Authority Regulations 1992 to
provide for the operation of the Country FireAuthority Appeals Commission.
2. Authorising provision
These Regulations are made under section 110 of the Country Fire Authority Act 1958.
3. Commencement
These Regulations come into operation on
5 December 1997.
4. Principal Regulations
In these Regulations the Country Fire Authority
Regulations 19921 are called the Principal
Regulations.

5. New heading to Division 3 of Part 3 substituted
For the heading to Division 3 of Part 3 of the
Principal Regulations substitute—"Division 3—Appeals Commission".
6. Substitution of regulation 29
For regulation 29 of the Principal Regulations
substitute—'29. Definitions
In this Division—
"Commission" means the Country Fire
Authority Appeals Commission
constituted under section 74A of theAct;
"Registrar" means the officer or employee
of the Authority appointed by the
Authority to carry out the duties and
functions of the Registrar under thisDivision.'.
7. Revocation of regulation 30
Regulation 30 of the Principal Regulations is revoked.
8. Substitution of regulation 31
For regulation 31 of the Principal Regulations
substitute—
"31. Notice of an appeal(1) A person wishing to appeal under Part VA of the Act must lodge a written notice of appeal with the Registrar not later than 14 days after he or she is sent or given notice of the matter against which he or she wishes to appeal.
(2) The notice must state the grounds of the
appeal.

S.R. No. 144/1997 r. 9 (3) The Commission may extend the period
within which a person may lodge a notice of
appeal if it is satisfied that the person was
not able to lodge the notice within the period
allowed by sub-regulation (1) through nofault of his or her own.".
9. Amendment of regulation 33
In regulation 33 of the Principal Regulations, for
"appeal lodged under regulation 31(1)" substitute"notice of appeal lodged under regulation 31".
10. Minor consequential amendments
In regulations 32, 33, 35 and 36 of the Principal
Regulations, for "Tribunal" (wherever occurring)substitute "Commission".
