Country Fire Authority Act 1958

Country Fire Authority Amendment Regulations 2008

The Governor in Council makes the following Regulations:

1Objective

The objective of these Regulations is to amend the Country Fire Authority Regulations 2004—

(a)to change the financial reporting requirements applying to brigades and groups; and

(b)to make consequential amendments to brigade and group model rules.

2Authorising provision

These Regulations are made under section 110 of the Country Fire Authority Act 1958.

3Principal Regulations

In these Regulations, the Country Fire Authority Regulations 2004[1] are called the Principal Regulations.

4Definition

In regulation 5 of the Principal Regulations insert the following definition—

"financial statements means the accounting records referred to in regulation 59A;".

5Financial records must be kept

In regulation 59 of the Principal Regulations, for "appropriate records of the financial affairs and assets" substitute "proper accounts and records of the financial transactions, affairs and assets".

6Insertion of new regulation 59A

After regulation 59 of the Principal Regulations insert

"59A   Financial statements to be prepared and provided to the Authority

(1)As soon as practicable after the end of each financial year, the secretary of a brigade or group or, if the brigade or group has a treasurer, the treasurer must prepare financial statements that show the financial operations and financial position of the brigade or group for that year, and submit the financial statements to the Authority—

(a)not later than 1 August next after the end of the financial year; or

(b)if the Authority specifies any other date in relation to a brigade or group, not later than that date.

(2)The Authority must give at least 28 days written notice of a date specified under subregulation (1)(b).

(3)Financial statements submitted under subregulation (1) must be in the form specified by the Authority.".

7Revocation of regulations 60 and 61

Regulations 60 and 61 of the Principal Regulations are revoked.

8Brigade Model Rules

(1)In rule 1 of Schedule 5 to the Principal Regulations, in paragraph (a) of the definition of officer in charge of a brigade for "and" substitute "or".

(2)For rule 18(1) of Schedule 5 to the Principal Regulations substitute

"(1)The secretary or, if the brigade has a treasurer, the treasurer must, at each annual general meeting—

(a)table the financial statements of the brigade in respect of the last financial year; and

(b)make a full report of the activities and financial operations and position of the brigade; and

(c)ensure that full reports of the activities and financial operations and position of clubs and auxiliary bodies associated with the brigade are made.".

(3)In rule 30(1) of Schedule 5 to the Principal Regulations—

(a)in paragraph (d) omit "bound";

(b)in paragraph (e) for "appeals" substitute "activities and grants";

(c)in paragraph (f) for "appeals" substitute "activities and grants".

(4)For rule 30(2)(b) of Schedule 5 to the Principal Regulations substitute

"(b)each set of the accounts is kept for 7 years from the date of submission of the brigade's financial statements to the Authority under the Regulations.".

(5)In rule 36(2) of Schedule 5 to the Principal Regulations, after "cheque" insert "or electronic funds transfer".

(6)Rule 38 of Schedule 5 to the Principal Regulations is revoked.

9Group Model Rules—annual general meeting

(1)For rule 10(1) of Schedule 6 to the Principal Regulations substitute

"(1)The secretary or, if the group has a treasurer, the treasurer must, at each annual general meeting—

(a)table the financial statements of the group in respect of the last financial year; and

(b)make a full report of the activities and financial operations and position of the group; and

(c)ensure that full reports of the activities and financial operations and position of clubs and auxiliary bodies associated with the group are made.".

10Group Model Rules—records

(1)In rule 20(1) of Schedule 6 to the Principal Regulations—

(a)after "secretary" insert "or, if the group has a treasurer, the treasurer";

(b)in paragraph (d) omit "bound";

(c)in paragraph (e) for "appeals" substitute "activities and grants";

(d)in paragraph (f) for "appeals" substitute "activities and grants".

(2)In rule 20(2) of Schedule 6 to the Principal Regulations—

(a)after "secretary" insert "or, if the group has a treasurer, the treasurer";

(b)for paragraph (b) substitute

"(b)each set of the accounts is kept for 7 years from the date of submission of the group’s financial statements to the Authority under the Regulations.".

(3)In rule 20(3) of Schedule 6 to the Principal Regulations, after "secretary" insert "or, if the group has a treasurer, the treasurer".

11Group Model Rules—petty cash, payments and reporting etc.

(1)In rule 23(1) of Schedule 6 to the Principal Regulations, after "secretary" insert "or, if the group has a treasurer, the treasurer".

(2)In rule 23(2)(a) of Schedule 6 to the Principal Regulations, after "secretary" insert "or, if the group has a treasurer, by the treasurer".

(3)In rule 25(1) of Schedule 6 to the Principal Regulations, after "secretary" insert "or, if the group has a treasurer, the treasurer".

(4)In rule 25(2) of Schedule 6 to the Principal Regulations—

(a)after "secretary" insert "or, if the group has a treasurer, the treasurer";

(b)after "cheque" insert "or electronic funds transfer".

(5)In rule 26 of Schedule 6 to the Principal Regulations, for "secretary or" substitute "the secretary, the treasurer or".

(6)In rule 27 of Schedule 6 to the Principal Regulations, after "secretary" insert "or, if the group has a treasurer, the treasurer".

(7)Rule 28 of Schedule 6 to the Principal Regulations is revoked.
