Country Fire Authority (Amendment) Regulations
2000
The Governor in Council makes the following Regulations:

1. Objective
The objective of these Regulations is to amend the
Country Fire Authority Regulations 1992—
(a)
to restructure the nature of membership of brigades; and
(b)
to make provision with respect to charges; and
(c)
to generally improve the operation of those Regulations.
2. Authorising provision
These Regulations are made under section 110 of
the Country Fire Authority Act 1958.

3. Principal Regulations
In these Regulations, the Country Fire Authority
Regulations 19921 are called the PrincipalRegulations.
4. Common seal
In regulation 9(2)(b) of the Principal
Regulations—
(a) for sub-paragraph (i) substitute— "(i) the Chairman or the Deputy Chairman or another Authority member who has been appointed by the Authority; and";
(b) in sub-paragraph (ii), for "Director Corporate Administration".
5. Categories of members
(1) In regulation 46 of the Principal Regulations, for
sub-regulation (1) substitute—
"(1) An urban brigade may have the following
categories of members—
(a) senior members;
(b) junior members.".(2) In regulation 46(2) of the Principal Regulations,
for paragraph (a) substitute—
"(a) senior members;".
6. Criteria for membership
In regulation 47 of the Principal Regulations, for
sub-regulations (1) and (2) substitute—"(1) A person is not eligible—
(a)
to join, or to transfer to, an urban brigade as a senior member; or

(b)
to remain a senior member of an urban brigade—
unless—
(c)
the person is capable of performing his or her duties as a member of that brigade without endangering his or her safety, or the safety of others; and
(d)
the person is 16 years of age, or more; and
(e)
the person is reasonably available to carry out the functions and duties of a member of a brigade; and
(f)
the person is of good moral character and habits.
(2) A person is not eligible—
(a)
to join, or transfer to, a rural brigade as a senior member; or
(b)
to remain a senior member of a rural brigade—
unless—
(c)
the person is capable of performing his or her duties as a member of that brigade without endangering his or her safety, or the safety of others; and
(d)
the person is 16 years of age, or more; and
(e)
the person is reasonably available to carry out the functions and duties of a member of a brigade; and
(f)
the person is of good moral character and habits.".

7. Applications
In regulation 48(1) of the Principal Regulations,
for paragraph (c) substitute—"(c) by a junior member to join a brigade as a
senior member—".
8. Probationary membership
(1) In regulation 50 of the Principal Regulations, for
sub-regulation (2) substitute—
"(2) A person transferring from one brigade to
another brigade who is not on probation as a referred to in sub-regulation (1).".

9. Revocation of reserve member and operational support member provisions
Regulations 51, 52 and 56 of the Principal
Regulations are revoked.
10. Junior members
In regulation 53 of the Principal Regulations, for
sub-regulation (2) substitute—"(2) Regulation 47 applies to a junior member
applying to become a senior member of a
brigade.".

11. Striking off the register
In regulation 55(b) of the Principal Regulations,
for sub-paragraph (ii) substitute—"(ii) is not reasonably available to perform his or
her functions and duties as a member of a
brigade—".
12. Eligibility to stand for election—brigades
In regulation 58(1)(b) of the Principal Regulations omit ", 51, 52".
13. Elections of brigade officers
In regulation 59(2) of the Principal Regulations, for "April or May in the year" substitute "the month and the year".
14. Eligibility to stand for election—groups
In regulation 62(1)(b) of the Principal Regulations omit ", 51, 52".
15. Elections for officers of the group
In regulation 63(2) of the Principal Regulations, for "May or June in the year" substitute "the month and the year".
16. Casual vacancies
In regulation 66(1) of the Principal Regulations—
(a) in paragraph (b) omit "or";
(b) paragraph (c) is revoked; and
(c)
for "paragraphs (a), (b) or (c)" substitute "paragraph (a) or (b)".
17. Physical fitness
In regulation 68(4) of the Principal Regulations, for "Authority" substitute "Chief Officer".

18. Training
In regulation 69(1) of the Principal Regulations, after paragraph (b) insert—
"; and
(c)
members performing different functions and duties.".
19. Fire protection charges
In regulation 112(1)(a) of the Principal
Regulations, for "approvals lodged under
section 20 of the Building Control Act 1981"
substitute "permits made under section 17 of theBuilding Act 1993".
20. Emergency attendances
In regulation 113(2) of the Principal
Regulations—
(a)
in paragraph (a), for "$291" substitute "$301";
(b)
in paragraph (b), for "$204" substitute "$211".
21. Revocation of training fees provision
Regulation 117 of the Principal Regulations is revoked.
22. New Part 8 inserted
After Part 7 of the Principal Regulations insert—
"PART 8—TRANSITIONALS
135. Active members
A person who, immediately before the
commencement of the Country Fire
Authority (Amendment) Regulations 2000,
was an active member of an urban brigade,

becomes, on that commencement, a senior
member of the brigade.
136. Reserve members
(1) A person who, immediately before the
commencement of the Country Fire was a reserve member of an urban brigade by reason of them being a member on probation, becomes, on that commencement, a senior member on probation.
(2) A person who, immediately before the
commencement of the Country Fire was a reserve member of an urban brigade but not a member on probation, becomes, on that commencement, a senior member of the brigade.
137. A person who, immediately before the
commencement of the Country Fire
Authority (Amendment) Regulations 2000,Operational support members urban brigade, becomes, on that commencement, a senior member of the brigade.
138. Regular members commencement of the Country Fire Authority (Amendment) Regulations 2000, was a regular member of a rural brigade, becomes, on that commencement, a senior member of the brigade.".
