GAUDRON J: Thank you. Mr Boe.
MR BOE: Given the grant of special leave in the previous matter, I did not propose to advance any further oral argument in relation to the supplementary point and, indeed, in relation to the original points, I only have matters of reply in relation to the respondent’s outline.
GAUDRON J: Yes. Why do not we simply stand your application over pending the outcome in Coleman?
MR BOE: There are different questions but I see no reason why it should not be left until after that question is decided.
GAUDRON J: Is that course resisted by the respondent, Mr Davis?
MR DAVIS: No, your Honour.
GAUDRON J: In that case the application will be stood over to be relisted pending the outcome of Coleman.
MR BOE: Thank you, your Honour.
