Prison (General) Amendment (Law Revision) Regulation 1999
under the
Correctional Centres Act 1952

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Correctional Centres Act 1952.

The objects of this Regulation are:

(a) to rename the Prisons (General) Regulation 1995 as the Correctional Centres (General) Regulation 1995, and
(b) to replace outdated references to prisons, prison complexes, prisoners and prison officers with references to correctional centres, correctional complexes, inmates and correctional officers respectively, and
(c) to make a minor amendment as a result of the renaming of the

Offenders Review Board as the Parole Board.

The amendments are consequential on the commencement of the Prisons Amendment Act 1996 and the Sentencing Amendment (Parole) Act 1996. The Prisons Amendment Act 1996 renamed the Prisons Act 1952 as the Correctional Centres Act 1952 and replaced references to prisons, prison complexes, prisoners and prison officers throughout the Act with references to correctional centres, correctional complexes, inmates and correctional officers respectively. The Sentencing Amendment (Parole) Act I996 changed the name of the Offenders Review Board to the Parole Board.

This Regulation is made under the Correctional Centres Act 1952, including section 50 (the general regulation-making power).

Information about Correctional Centre Discipline

1.      The Correctional Centres (General) Regulation 1995 specifies correctional centre offences. Some of these (minor correctional centre offences) may be adjudicated on by the governor of the correctional centre. All may be adjudicated on by a Visiting Justice.

2. If you are charged by the governor of the correctional centre and are found guilty, the governor may impose one of the penalties specified in section 25 (2) of the Correctional Centres Act 1952.

3.      The governor must conduct an inquiry into any allegation of a minor correctional centre offence. You are not entitled to legal representation at this inquiry. If you do not understand the nature of the inquiry or understand English clearly you must inform the governor immediately so that assistance may be sought.

4.      During or after the inquiry, the governor may refer the allegation to the Visiting Justice for determination.

5.      If the Visiting Justice is to hear a charge, you are entitled to legal representation. This can be provided by the Prisoner Legal Service of the Legal Aid Commission. A representative of that Service attends most of the Visiting Justice’s hearings.

6. The Visiting Justice may impose a penalty as specified in section 26B of the Correctional Centres Act 1952. Such a penalty may increase the time you have to serve in a correctional centre.
