Corporations Regulations2 (Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Corporations Act 1989.

1.   Amendment

1.1   The Corporations Regulations are amended as set out in these Regulations.

[NOTE:  These Regulations commence on gazettal: see Acts Interpretation Act 1901, s 48.]

2. Regulation 8.1.01 (Exemption from Parts 8.3, 8.4 and 8.5 of the Corporations Law)

2.1   Omit the regulation, substitute:

Exemption from Parts 8.3, 8.4 and 8.5 of the Corporations Law

 “8.1.01. Parts 8.3, 8.4 and 8.5 of the Corporations Law do not have effect in relation to a service as a futures adviser or futures broker that is provided:

  • (a)

    by a body to another body that:

    • (i)

      owns or controls the first-mentioned body; and

    • (ii)

      conducts an exempt futures market; or

  • (b)

    by CSR Limited to the Crown in the right of Queensland, to the Queensland Sugar Board or to another public authority of Queensland in connection with the sugar industry; or

  • (c)

    by Snowy Hydro Trading Pty Ltd to the Commonwealth, to Pacific Power or to the State Electricity Commission of Victoria in connection with an exempt futures market conducted in Australia in relation to the wholesale price of electricity.”.
