Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Corporations Act 1989.

1.    Amendment

1.1   The Corporations Regulations are amended as set out in these Regulations.

[NOTE:

  These Regulations commence on gazettal: see Acts Interpretation Act 1901, s.48.]

2.   Regulation 7.1.03 (Prescribed index: definition of “option contract”)

2.1   Regulation 7.1.03:

Add at the end:

• “; (f)

  the Australian Stock Exchange All Industrials Share Price Index;

• (g)

  the Australian Stock Exchange All Resources Share Price Index.”.

3.    New Chapter 10

3.1   After Chapter 9, insert:

“CHAPTER 10—MODIFICATION OF THE CO-OPERATIVE SCHEME ACTS

PART 10.1—COMPANIES AND SECURITIES (INTERPRETATION AND MISCELLANEOUS PROVISIONS) ACT 1980

Modification of the Companies and Securities (Interpretation and Miscellaneous Provisions) Act 1980

 10.1.01 The Companies and Securities (Interpretation and Miscellaneous Provisions) Act 1980 has effect with the modifications set out in this Part.

Modification of section 34 (Time for instituting criminal proceedings)

 10.1.02 Section 34 is modified as follows:

• (a)

  after “Ministerial Council”, insert “ or the Minister”;

• (b)

  add at the end:

“(2)

For the purposes of this section, ‘the Minister’ has the same meaning as ‘the Minister’ under section 80A(2) of the Corporations Law.”.
