Corporations Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Corporations Act 1989.

1.   Amendment

1.1   The Corporations Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 3.8.01 (Annual return)

2.1   After paragraph (k), insert:

• “(ka)

  whether:

  • (i)

    the company operates solely for the purpose of acting as the trustee of a regulated superannuation fund within the meaning of section 19 of the Superannuation Industry (Supervision) Act 1993; and

  • (ii)

    the memorandum of the company prohibits the distribution of its income or property among its members, regardless of whether or not the company has a share capital.”.
