Corporations Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Corporations Act 1989.

1.   Amendment

1.1   The Corporations Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   New regulation 1.17

2.1   After regulation 1.16, insert in Part 1.0:

Modification of Securities Industry Act 1980

 “1.17. For the purposes of section 79 of the Corporations Act 1989, section 36B of the Securities Industry Act 1980 is modified as set out in Schedule 9B.”.

3.   New Schedule 9B

3.1   After Schedule 9A, insert:

“SCHEDULE 9B Regulation 1.17

MODIFICATION OF THE SECURITIES INDUSTRY ACT 1980

1.Section 36B:

1.1 Add at the end of the section:

 ‘(4) Subsection (1) does not prevent the Exchange from transferring its place of incorporation in accordance with section 147 of the Corporations Law.’ ”.
