s1 2 s5 Corporations (Queensland) Amendment (No. 1) No. 246, 1995 ˙ Short title 1. This rule may be cited as the Corporations (Queensland) Amendment Rule (No. 1) 1995 . ˙ Rules amended 2. This rule amends the Corporations (Queensland) Rules 1993 . ˙ Amendment of r 42 (Day for application and notice of day fixed (form 10)) 3. Rule 42(2), ‘days of’— omit, insert— ‘days from’. ˙ Amendment of r 64 (Attendance before registrar) 4. Rule 64(1)(d)— omit, insert— ‘(d) the Commission has been given notice of the application; and (e) the applicant has properly complied with these rules in relation to applications for a winding up order.’. ˙ Amendment of r 68 (Notice of winding up order, service of copy and notice at foot (s.470(2)) (form 17)) 5. Rule 68(1)(b)— omit, insert— ‘(b) as soon as practicable after the passing and entering of the order, gazette and advertise a notice in form 17 of the making of the order; and (c) within 7 days after the passing and entering of the order, serve on the liquidator an office copy of the order together with a statement that section 470(2)(b) has been complied with.’.

Rule 76(1), ‘must’— omit, insert— ‘may’. ˙ Amendment of r 99 (Applicant’s costs in winding up) 7. Rule 99, heading— omit, insert— ‘ Applicant’s costs when winding up order made ’. ˙ Insertion of new r 99A 8. After rule 99— insert— ˙ ‘ Applicant’s costs when winding up application is dismissed with costs to the applicant ‘ 99A.(1) This rule applies if a winding up application has been dismissed with costs to the applicant. ‘ (2) The applicant’s professional fees for the order allowable on taxation are, at the applicant’s election, to be an amount of not more than $1 000. ‘ (3) The fees mentioned in subrule (2) are in addition to the applicant’s proper disbursements. ‘ (4) If an applicant makes an election under subrule (2), the applicant need not itemise details of work done by the applicant’s solicitors in any bill of costs.’. ˙ Amendment of sch 1 (Forms) 9.(1) Schedule 1, form 7, after ‘larger amount’— insert— ‘than’.
