Queensland Subordinate Legislation 1991 No. 67 ORDER IN COUNCIL At the Executive Building, Brisbane, the fifth day of September, 1991 Present: The Deputy Governor, for and on behalf of His Excellency the Governor in Council The Deputy Governor, for and on behalf of His Excellency the Governor, acting by and with the advice of the Executive Council and in pursuance of the provisions of the SupremeCourtAct1921 and the Corporations(Queensland) Act 1990 and with the concurrence of the required number of Judges of the Supreme Court, hereby makes the following Rules of Court. And the Honourable the Minister for Justice and Corrective Services is to give the necessary directions herein accordingly. E. J. BIGBY, Clerk of the Council RULES OF COURT Corporations (Interim) Rules 1991 Short title 1. These rules may be cited as the Corporations (Interim) Rules 1991 . Commencement 2. These Rules come into force on the date of their publication in the Gazette.
2 Rules under Supreme Court Act 1921 and Corporations (Queensland) Act 1990 Definitions 3. In these Rules— “Principal Rules” means the Companies (Queensland) Rules 1985 ; “proceedings” includes a step in a proceeding. Application 4.(1) The provisions of the Principal Rules apply so far as practicable to proceedings, taken or to be taken, for relief under the Corporations Law of Queensland. (2) In applying this Rule— (a) a reference to the Commission or the Commissioner is to be construed as a reference to the Australian Securities Commission established under the Australian Securities Commission Act 1989 (Commonwealth); (b) a reference to the Companies (Queensland) Code is to be construed as a reference to the Corporations Law of Queensland. Savings 5.(1) Nothing in these Rules invalidates proceedings that, apart from these Rules, are or would have been valid. (2) In matters not provided for by these Rules, proceedings are regular if taken in accordance with a direction of the Court or a Judge or Master, or if declared by the Court or a Judge or Master to be or to have been regular.
