Corporations (Ancillary Provisions) (Consequential

Amendments) Regulations 2001

The Governor in Council, on the recommendation of the
Attorney-General, makes the following Regulations:

1. Objective

The objective of these Regulations is to amend certain statutory rules as a consequence of the enactment by the Parliament of the

Commonwealth of the new Corporations Act and certain other Acts.

2. Authorising provision

These Regulations are made under section 22 of
the Corporations (Ancillary Provisions) Act

2001.

3. Commencement

These regulations come into operation when the
Corporations (Consequential Amendments)
Act 2001 comes into operation.

4. Consequential amendments

A statutory rule specified in the heading to an item in the Schedule is amended as set out in that item.

Regulation 4

CONSEQUENTIAL AMENDMENTS

1. Accident Compensation Regulations 2001

In regulation 22(1), for "the Corporations Law" substitute
"section 50 of the Corporations Act".

2. Associations Incorporation Regulations 1998 2.1 Regulations 10, 11 and 12 are revoked. 2.2 In Schedule 5, in clause 24(b), for "Corporations Law"

substitute "Corporations Act".

3. Children's Services Regulations 1998

In Schedule 1, in the definition of "company", for

"Corporations Law" substitute "Corporations Act".

4. Co-operative Housing Societies Regulations 1995

In regulation 19, for "Corporations Law" (where twice occurring) substitute "Corporations Act".

5. Co-operatives Regulations 1997

5.1 In regulation 6(c), for "Corporations Law" substitute

"Corporations Act".

5.2 Regulations 13, 14 and 29 are revoked.

5.3 In regulation 42, for paragraphs (h) and (i) substitute—

"(h) disclosure documents lodged with the Registrar under

Part 6D.2 of the Corporations Act (as applied by section 263 of the Act);

(i)  documents lodged with the Registrar under Part 5.3A of the Corporations Act (as applied by section 323 of the Act);".

6. Consumer Credit (Victoria) (Administration) Regulations 1996

In regulation 9—

(a) in paragraph (b), for sub-paragraph (iii) substitute—

"(iii) if the person becomes disqualified from

managing a corporation under section 206B of

the Corporations Act;";

(b) in paragraph (c)(iii), for "Corporations Law" substitute "Corporations Act".

7. Domestic Building Contracts and Tribunal (Notice) Regulations 1996

In regulation 4(b)(iii), for "Corporations Law" substitute

"Corporations Act".

8. Estate Agents (General, Accounts and Audit) Regulations 1997

In regulation 10(3), for "Corporations Law" substitute

"Corporations Act".

9. Introduction Agents Regulations 1998

In Schedule 1, in SECTION B—CORPORATIONS, in
question (f), for "Part 5 of the Corporations Law" substitute

"Chapter 5 of the Corporations Act".

10. Mineral Resources (Royalties) Regulations 1991

In regulation 5(2)(b), for "a corporation (within the meaning of Corporations Law) which is a related corporation" substitute "a body corporate (within the meaning of Corporations Act) which is a related body corporate".

11. Motor Car Traders Regulations 1998

In regulation 22(8)(c)(iv), for "Corporations Law" substitute "Corporations Act".

12. Private Agents Regulations 1990

In regulation 6, for sub-regulation (1) substitute—

"(1) Employees of bodies corporate which are related to

another body corporate by virtue of section 50 of the this Act in relation to—

(a)

finding or repossessing goods or chattels which are the subject of a hire-purchase agreement or a bill of sale; or

(b) collecting or requesting the payment of debts—

on behalf of the body corporate which is related to

their employer.".

13. Trustee (Secondary Mortgage Market) Regulations 1995

"Related bodies corporate within the meaning of the Corporations Act".

14.1 In regulation 3, in the definition of "member", for

14.2 In the Notes to the Schedule—

(a)

in the definition of "prescribed stock exchange", for "Corporations Law" substitute "Corporations Act";

(b)

in the definition of "related party", in paragraph (d), for "Part 1 of the Corporations Law" substitute "Part 1.2 of the Corporations Act".
