s1 2 s4 Coroners Amendment Rule (No. 1) 2002 No. 243, 2002 1 Short title This rule may be cited as the Coroners Amendment Rule (No. 1) 2002 . 2 Regulation amended This rule amends the Coroners Rules 1959. 3 Amendment of r 2 (Definitions) Rule 2— insert— ‘ “chief executive (health)” means the chief executive of the department in which the Health Act 1937 is administered. “preliminary report” means, in the context of a person being required to report the result of a post-mortem examination or special examination to the coroner, a report the person prepares as a preliminary step to record or give information of any type before the reporting of the result is finalised.’. 4 Amendment of r 11 Rule 11— insert— ‘ (3) Despite subrule (2), the person making a post-mortem examination— (a) must, if at any time the chief executive asks for a copy of the person’s report, or of any preliminary report, give the chief executive the copy; and (b) must, if at any time the chief executive (health) asks for a copy of the person’s report, or of any preliminary report, give the chief executive (health) the copy. ‘ (4) Without limiting the available forms of request under subrule (3)(a) or (b), a request may be in the form of any of the following— (a) a request to be given a copy of the report, and a copy of any preliminary report, concerning a particular deceased person;
s5 3 s5 Coroners Amendment Rule (No. 1) 2002 No. 243, 2002 (b) a standing request to be given copies of all reports, and of all preliminary reports, of a particular category; Example — The chief executive (health) could ask a person to give the chief executive (health) copies of all reports and preliminary reports for post-mortem examinations the person makes at any time relating to deaths of persons under the age of 1 year. (c) a standing request to be given copies of all reports and preliminary reports.’. 5 Amendment of r 13 (Special examinations) Rule 13— insert— ‘ (3) Despite subrule (2), the person making a special examination— (a) must, if at any time the chief executive asks for a copy of the person’s report, or of any preliminary report, give the chief executive the copy; and (b) must, if at any time the chief executive (health) asks for a copy of the person’s report, or of any preliminary report, give the chief executive (health) the copy. ‘ (4) Without limiting the available forms of request under subrule (3)(a) or (b), a request may be in the form of any of the following— (a) a request to be given a copy of the report, and a copy of any preliminary report, concerning a particular deceased person; (b) a standing request to be given copies of all reports, and of all preliminary reports, of a particular category; Example — The chief executive (health) could ask a person to give the chief executive (health) copies of all reports and preliminary reports for special examinations the person makes at any time relating to deaths of persons under the age of 1 year.
