s1 3 s4 Coroners Amendment (No. 1) No. 326, 1998 ˙ Short title 1. This rule may be cited as the Coroners Amendment Rule (No. 1) 1998 . ˙ Rules amended 2. This rule amends the Coroners Rules 1959 . ˙ Replacement of ss 2–4 3. Sections 2 to 4— omit, insert — ˙ ‘ Definitions ‘ 2. In these rules— “government medical officer” means a person appointed as a government medical officer under the Constitution Act 1867 , section 14. 1 “health service employee” see the Health Services Act 1991 , section 2. 2 ’. ˙ Amendment of s 5 (Oath of office) 4.(1) Section 5, first sentence, ‘paragraph (a) of subsection two of section six’— omit, insert — ‘section 6(2)’. (2) Section 5, second sentence, from ‘Under Secretary’— omit, insert— ‘chief executive.’. 1 Section 14 (Appointment to offices under the government of the colony to be vested in the Governor in Council or alone) 2 Section 2 (Definitions)

Section 6, ‘Form No. 4 set forth in the Schedule to these Rules shall’— omit, insert— ‘a report in the approved form’. ˙ Amendment of s 11 6. Section 11(1), from ‘form set forth’— omit, insert— ‘approved form.’. ˙ Amendment of s 12 7. Section 12(1), ‘ “ The Liquor Acts, 1912 to 1958 ,” ’— omit, insert — ‘the Liquor Act 1992 ’. ˙ Amendment of s 14 (Committal for trial) 8. Section 14, ‘by “ The Justices Acts, 1886 to 1958 ,” ’— omit, insert— ‘by, or approved under, the Justices Act 1886 ,’. ˙ Amendment of s 16 9. Section 16, ‘Under Secretary’— omit, insert— ‘chief executive’.
s 10 5 s 12 Coroners Amendment (No. 1) No. 326, 1998 ˙ Amendment of s 17 (Allowances payable to a medical practitioner for making a post-mortem or other examination) 10.(1) Section 17(1), ‘salaried’— omit, insert — ‘a public service employee or a’. (2) Section 17— insert — ‘ (2A) The allowances payable under the Act to a government medical officer for certain matters are in schedule 4. 3 ’. ˙ Replacement of s 19 (Witnesses’ expenses) 11. Section 19— omit, insert — ˙ ‘ Witness and interpreter allowances ‘ 19. A witness or an interpreter is entitled to be paid allowances under schedule 2, section 2 4 for attending court.’. ˙ Amendment of s 22 12.(1) Section 22(a), from ‘That’ to ‘him’— omit, insert— ‘an investigating police officer for a death to give the coroner a report, in the approved form,’. (2) Section 22(b), from ‘That’ to ‘him’— 3 Schedule 4 (Certain allowances payable to government medical officers) 4 Schedule 2, section 2 (Witness allowances)

Schedule 1— omit. ˙ Amendment of sch 2 (Allowances to witnesses attending inquests) 14.(1) Schedule 2, heading, after ‘ Witnesses ’— insert— ‘ or interpreters ’. (2) Schedule 2, section 2, heading, after ‘ Witness ’— insert— ‘ or interpreter ’. (3) Schedule 2, section 2(1)— omit, insert — ‘ 2.(1) A witness or interpreter is entitled to be paid the following allowances for attending court— (a) a travelling allowance; (b) an accommodation allowance; (c) an attendance allowance. ‘ (1A) For a witness (other than a professional or expert witness who is a government medical officer) or an interpreter, the allowances are to be paid under this schedule. ‘ (1B) For a professional or expert witness who is a government medical officer—
s 14 7 s 14 Coroners Amendment (No. 1) No. 326, 1998 (a) the travelling allowance is to be paid under this schedule, section 3(1)(c) and (2) to (4) and schedule 4; and (b) the accommodation allowance is to be paid under this schedule, section 4; and (c) the attendance allowance is to be paid under schedule 4.’. (4) Schedule 2, section 3(1)(b)— omit, insert— ‘(b) for a witness, other than a professional or expert witness who is a government medical officer—if there is no public transport available, the amount calculated, to the nearest cent, at the rate payable to a public service officer under a directive or guideline issued under the Public Service Act 1996 , section 34(1); 5 or (c) for a professional or expert witness who is a government medical officer—the amount calculated to the nearest cent at the rate payable under schedule 4.’. (5) Schedule 2, section 3(3), ‘subclause (1)(b)’— omit, insert — ‘subsection (1)’. (6) Schedule 2, section 4(1), from ‘an officer’— omit, insert— ‘a public service officer under a directive or guideline issued under the PublicService Act 1996 , section 34(1) 6 .’.
