An Ordinance to amend the Coroners Ordinance 1956

I, T H E G O V E R N O R - G E N E R A L of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following

Ordinance under the Seat of Government (Administration) Act 1910.

C O R O N E R S ( A M E N D M E N T ) O R D I N A N C E 1980

Short title

1. This Ordinance may be cited as the Coroners (Amendment) Ordinance

1980.1

Commencement

2. This Ordinance shall come into operation on a date to be fixed by the Minister of State for the Capital Territory by notice in the

Gazette.

(a) a reference in the relevant provisions to the Court of Petty Sessions
shall be read as a reference to the Coroner;

3. Section 29 of the Coroners Ordinance 1956 2 is repealed and the follow­

ing section substituted:

Recording of proceedings

"29. (1) Subject to sub-section (2), sections 54A, 60, 255B and 255C of the Court of Petty Sessions Ordinance 1930 (in this section called 'the relevant provisions') apply in relation to the depositions of a witness who gives evidence at an inquest or inquiry as if those depositions were depositions in proceedings in the Court of Petty Sessions.

" (2) For the purposes of sub-section (1)—

(b)

a reference in the relevant provisions to the Clerk of the Court of Petty Sessions shall be read as a reference to the Clerk of the Coroner's Court;

(c)

sub-section 255B (1) applies as if the proceedings at an inquest or in­ quiry were proceedings referred to in paragraph 255B (1) (a); and

(d)

section 255C applies as if the following sub-section were substituted for sub-section 255C (2):

'(2) A person is not entitled to make an application under this sec­ tion in relation to a record made at an inquest or inquiry unless he has satisfied the Clerk or a Coroner that he has good reasons for so applying.'.".
