1Name

This instrument is the Coronavirus Economic Response Package (Payments and Benefits) Amendment Rules (No. 5) 2020.

2Commencement

1. (1)

   Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

This instrument is made under the Coronavirus Economic Response Package (Payments and Benefits) Act 2020.

4Schedules

Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Amendments

Coronavirus Economic Response Package (Payments and Benefits) Rules 2020

Subsection 4(1)

Insert:

approved child care service has the same meaning as in the A New Tax System (Family Assistance) (Administration) Act 1999.

approved provider has the same meaning as in the A New Tax System (Family Assistance) (Administration) Act 1999.

At the end of subsection 9(4)

Add:

1. ; or (d)

   for an entity that is an approved provider of one or more approved child care services—at any time in the fortnight, the ordinary duties of the individual’s employment relate principally to the operation of one or more of those services (whether or not the individual performed duties of that kind in the fortnight).

After paragraph 11(1)(b)

Insert:

1. (ba)

   the entity is not the approved provider of an approved child care service; and

108Application

The amendments made by items 1 to 3 of Schedule 1 to the Coronavirus Economic Response Package (Payments and Benefits) Amendment Rules (No. 5) 2020 apply in relation to jobkeeper fortnights beginning on or after 20 July 2020.
