CaseChat Overview and Summary
The primary legal issue before the FWC was whether the terms of the proposed agreement were fair and reasonable, as required by the Fair Work Act 2009. This involved an examination of whether the agreement provided for fair rates of pay and conditions, and whether it complied with the relevant national employment standards. The FWC also needed to assess whether the agreement appropriately balanced the interests of both employers and employees, and whether it met the prerequisites for approval as stipulated in the Act.
The FWC determined that the proposed agreement met the necessary criteria for approval. The court found that the agreement provided for fair and reasonable terms and conditions, including appropriate wage rates and other employment conditions. The FWC also concluded that the agreement appropriately balanced the interests of both parties and complied with the national employment standards. As a result, the FWC approved the Cormack Packaging MFG Pty Ltd Enterprise Agreement 2021-2024. The approval ensures that the terms of the agreement will be legally enforceable, providing certainty for both the employer and employees moving forward.
