An appeal by Corish Farms Pty Ltd against a decision made by the
Chief Executive, Department of Natural Resources to amend
Water Licence No. 47929H – Water Resources Act 1989.
O R D E R S
The parties having agreed to this matter being determined by consent without the need for an oral hearing, pursuant to Rule 35 of the Land Court Rules 2000, it is ordered as follows:
1. The appeal is allowed.
2.As provided by s.51(7) of the Water Resources Act 1989, the decision of the chief executive subject of the appeal is varied.
3.Licence No. 47929H is to be issued with amended terms and conditions in accordance with the draft licence "A" attached hereto.
4.Each party bear their own costs of the appeal.
