COMMISSIONER YILMAZ | MELBOURNE, 27 AUGUST 2021 |
Application for approval of the Corangamite Catchment Management Authority Enterprise Agreement 2021-2025.
[1] An application has been made for approval of an enterprise agreement known as the Corangamite Catchment Management Authority Enterprise Agreement 2021-2025 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Corangamite Catchment Management Authority. The Agreement is a single enterprise agreement.
[2] The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement. The undertakings are taken to be a term of the Agreement.
[3] Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 are relevant to this application for approval and have been met. The Agreement does not cover all of the employees of the employer, however, taking into account the factors in ss.186(3) and (3A) I am satisfied that the group of employees was fairly chosen.
[4] The Australian Municipal, Administrative, Clerical and Services Union being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.
[5] The Agreement is approved and in accordance with s.54, will operate from 3 September 2021. The nominal expiry date of the Agreement is 22 February 2025.

CaseChat Overview and Summary
The legal issues before the Commission included whether the agreement provided adequate protection for employee entitlements, whether it complied with minimum wage rates and penalty rates, and whether it appropriately addressed dispute resolution mechanisms. The Commission also had to consider whether the agreement was made in good faith and whether it adhered to the provisions for minimum terms and conditions as stipulated in the Act.
In deliberating on these issues, the Fair Work Commission reviewed the content of the proposed agreement against the benchmarks set by the Fair Work Act and relevant industrial awards. The Commission found that the agreement was comprehensive and adhered to the statutory requirements. It provided for fair and reasonable terms of employment, included appropriate minimum wage rates and penalty rates, and contained effective dispute resolution mechanisms. The Commission was satisfied that the agreement was made in good faith and met the legislative standards.
The Commission approved the Enterprise Agreement 2021-2025, affirming that it was fit for purpose and compliant with all necessary legal requirements. The approval was based on the evidence presented and the Commission's assessment that the agreement provided for fair and reasonable terms for employees within the Corangamite Catchment Management Authority.
