STATUTORY RULES.
PROVISIONAL REGULATIONS UNDER THE COPYRIGHT ACT 1905.
I,
THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the
advice of the Federal Executive Council, do hereby certify that the following
Regulations under the

THE COPYRIGHT REGULATIONS 1906.
1. These Regulations may be cited as The Copyright Regulations 1906.
2. In these Regulations:—
“The Act” means
The Copyright Act 1905.
3. The fees to be paid under the Act and these Regulations shall be those specified in the First Schedule, and shall be paid in cash at the Copyright Office.
4. The Forms contained in the Second Schedule may, so far as they are applicable, he used in any proceeding under the Act or these Regulations to which they are appropriate.
5. Except in the case of holidays observed under the
6. Every application for the registration of a copyright, performing right, or lecturing right, must be left at the Copyright Office, or sent by prepaid letter through the post, and must be accompanied by the prescribed fee.
7. Where an application for registration is made by an owner of a copyright, performing right, or lecturing right, other than the author of the book, musical or dramatic work, lecture, or artistic work, he shall in his application trace the devolution of title from the author to himself, and shall attach thereto the assignment or assignments by virtue of which he derives his title to the copyright, performing right, or lecturing right, with an attested copy thereof, or of each (if more than one).
8. Every application for the registration of a copyright, performing right, or lecturing right, shall be accompanied by a statement of address, to which all notices, requisitions, and communications of every kind may be sent by the Registrar.
9. In the case of an application for the registration of copyright in a work of art, the owner shall, if he desires a sketch, outline, or photograph of the work to be inserted in the Register, furnish the Registrar with six copies of the sketch, outline, or photograph, of a size not greater than 3 inches one way and 6 inches the other.
10. (1) Declarations, for the purpose of the Act and these Regulations, may be taken or made before any of the following persons:—
(
a ) In Australia—the Registrar, a Deputy-Registrar, a Notary Public, a Justice of the Peace, a Commissioner for Affidavits, or a person authorized by any Act or State Act to administer oaths or take declarations.(
b )In British Dominions other than Australia—any Judge, Magistrate, Justice of the Peace, Notary Public, Commissioner for Oaths or Affidavits, or a person lawfully authorized to administer oaths or take declarations.(
c ) In foreign countries—any Judge of a Superior Court, British Consul or Consular Officer, or Notary Public.
(2) The Registrar may take notice of the signature to any declaration and of the signature of the person before whom it purports to have been declared, without proof of those signatures or any other evidence relating thereto.
11. (1) When any person becomes entitled to any copyright, performing right or lecturing right, or to any interest therein, by virtue of an assignment or transmission, a request for the entry of his name in the Register shall be left at or sent by post to the Copyright Office,
(2) The request may be in the Form E or F in the Second Schedule, as the case requires, and shall be made and signed by the person claiming to be registered as owner or licensee, or by his agent, and shall be accompanied by the deed or document upon which he bases his request for registration.
(3) An attested copy of every deed and document affecting the ownership of the copyright, performing right, or lecturing right, or of any licence thereunder, shall accompany the request.
(4) The Registrar, if satisfied with the request, shall register the assignment, transmission, or licence by entering particulars thereof in the proper register.
12. The Registers of Copyrights shall be open to the inspection of the public during office hours on every day during which the Copyright Office is open, except on the days and at the times following:—
(
a ) Days which are from time to time notified by a placard posted in a conspicuous place at the Copyright Office.(
b ) Times when the Registers are required for any purpose of official use.
13. The certificate of registration issued by the Registrar in respect of an application may be in accordance with such of the forms in the Second Schedule as is appropriate to the case.
14. The Registers of Copyrights may be altered or amended by the Registrar in the following cases:—
(
a ) Where the error in entry has been made purely through the fault of the office.(
b ) Where the error in entry has been made through accident on the part of an applicant or his agent, and not from wilful default.
In the latter case, however, no amendment shall be made unless the owner of the copyright, performing right, or lecturing right, lodges at the Copyright Office a request to amend, accompanied by the prescribed fee.
15. Any document for the amendment of which no special provision is made by the Act may be amended, and any irregularity in procedure, which, in the opinion of the Registrar, may be obviated without detriment to the interests of any person, may be corrected if, and on such terms as, the Registrar thinks fit. An application to amend shall be accompanied by the prescribed fee.
16. Any notice of address for service or appointment of agent left at or sent to the Copyright Office shall be binding on the person giving the notice until notice of revocation, or of the appointment of some other address for service, or of some other agent, has been furnished by him to the Registrar.
17. (1) An application to the Minister under Section 30 of the Act shall be in accordance with Form H, and shall be lodged by being left at the Copyright Office under cover of a Request to Transmit addressed to the Registrar, and accompanied by the prescribed fee.
(2) There shall be attached to the application a statement showing particulars of the applicant’s capacity to perform the work of translation.
(3) Thereupon the Registrar shall examine the contents of the application, and shall ascertain whether the correct name and address of the owner of the copyright, as appearing therein, have been inserted in the Application form, also whether, to the best of his knowledge, the other particulars in the form are correct. He shall then forward the application to the Minister, accompanied by such remarks as may appear to him suitable, and by one of the copies of the book which were originally lodged.
(4) After decision by the Minister, the documents and book shall be returned to the Copyright Office, and there shall be inserted in the Register, opposite the entry of registration of the copyright, a note of the application, and of the decision of the Minister.

NOTICE UNDER SECTION 54 Of THE ACT FORBIDDING THE PERFORMANCE OF A MUSICAL OR DRAMATIC WORK.

I hereby give you notice that (2) am/is the owner of the performing right in a (3) work called (4) which performing right was registered in the Copyright Office on the day of 19 , and that I have reasonable ground to believe that you are about to perform or take part in the performance of the said work at (5) in infringement of the said performing right.

REQUEST UNDER SECTION 56 OF THE ACT FOR THE SEIZURE BY THE POLICE OF PIRATED BOOKS OR WORKS.
