REGULATIONS MADE UNDER THE COPPER AND BRASS STRIP BOUNTY ACT 1962.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Copper and Brass Strip Bounty Act 1962.

COPPER AND BRASS STRIP BOUNTY REGULATIONS.

Citation.

1. These Regulations may be cited as the Copper and Brass Strip Bounty Regulations.

Interpretation.

2.—(1.) In these Regulations, unless the contrary intention appears—

“authorized agent” means a person appointed in pursuance of regulation 3 of these Regulations to be an authorized agent for the purposes of these Regulations;

“producer” means a producer of metal strip;

“quarter” means the period of three months which commences on the first day of October, the first day of January, the first day of April, the first day of July in each of the years to which the Act applies; and

“the Act” means the Copper and Brass Strip Bounty Act 1962.

(2.) In these Regulations, a reference to a form by number shall be read as a reference to a form so numbered in the Schedule to these Regulations.

Authorized agents.

3.—(1.) A producer may appoint a person to be his authorized agent for the purposes of executing on his behalf a notice, declaration, certificate or document which the producer is required to execute by, or for the purposes of, the Act or these Regulations and the authorized agent may execute, on behalf of the producer, that notice, declaration, certificate or document.

(2.) Where a notice, declaration, certificate or document referred to in the last preceding sub-regulation has been executed by an authorized agent of a producer, the producer is subject to the same liabilities and penalties as if he had executed that notice, declaration, certificate or document

(3.) The appointment of an authorized agent shall be—

(a) in accordance with Form 1; and

(b)lodged with the Collector for the State in which the producer produces metal strip.

Authorizations under section 20 of the Act,

4. An authorization in pursuance of section 20 of the Act shall be—

(a) in accordance with Form 2; and

(b)lodged with the Collector for the State in which the producer produces metal strip.

Notice of intention to claim bounty.

5.—(1.) A producer who intends to claim bounty in respect of metal strip shall, within two months, after—

(a) the date of commencement of these Regulations; or

(b) the date on which he commences to produce metal strip,

whichever is the later, give notice of his intention to claim bounty to the Collector for the State in which he produces metal strip.

(2.) A notice under the last preceding sub-regulation shall be in accordance with Form 3.

Application for bounty.

6.—(1.) An application for bounty in respect of metal strip shall be—

(a)lodged with the Collector for the State in which the metal strip was produced within two months after the expiration of the quarter in which the metal strip was sold for use in Australia, or within such further time as the Collector in a particular case, may allow; and

(b) accompanied by a declaration by the producer.

(2.) An application and an accompanying declaration referred to in the last preceding sub-regulation shall be in accordance with Form 4.

I, (a)  hereby authorize (b), a specimen of whose signature appears hereunder, to receive on my behalf, subject to the provisions of the Copper and Brass Strip Bounty Act 1962 and the regulations made thereunder, all bounty and advances on account of bounty payable to me under that Act.

NOTICE OF INTENTION TO CLAIM BOUNTY.

(b) Insert the name of producer.

(c) Insert address of premises.

(d) Signature of producer or his authorized agent.

APPLICATION FOR BOUNTY.

To the Collector of Customs for the State of

(a)Insert name and address of producer or his authorized agent.

I, (a)  hereby apply for bounty in respect of metal being metal strip not exceeding 15 inches in width and not exceeding 0.012 inches in thickness produced at premises at (b)

and, during the quarter beginning

(b)Insert address of premises.

, 19 , sold for use in Australia.

(c) Insert copper or brass.

(d)To be inserted only in relation to brass strip.

The particulars relating to the metal strip covered by the application are as follows:—

I, (a)

hereby declare—

1. That for the purposes of the above Act, I am the (f) of the metal strip specified in the foregoing application for bounty.

(f) Insert “producer” or “authorized agent of the producer” whichever is applicable.

2. That the metal strip was produced at premises which were, at the time the metal strip was produced, registered under section 11 of the above Act or became so registered after that time.

3. That the whole of the metal strip was of good and merchantable quality.

4. That the particulars relating to the metal strip set out in the foregoing application for bounty are true and correct in every particular.

5. That nothing on my part has been done or omitted to be done and, to the best of my knowledge and belief, nothing on the part of any other person has been done or omitted to be done, whereby the right of the producer to bounty has been forfeited or taken away.

6. That to the best of my knowledge—

(a)no other application for bounty has been made; and

(b) no bounty has been paid,

in respect of the strip metal specified in the foregoing application for bounty.

7. That no advance has been paid under section 19 of the Act or, as the case may be.
