wurguslnu^ 89 ANNO OCTODECIMO ELIZABETHAE SECUNDAE REGINAE No. 17 of 1969 An Act to Amend The Co- ordination of Rural Advances and Agricultural Bank Acts 1938 to 1965 in certain particulars , and for other purposes [ASSENTED TO 17TH DECEMBER, 1969] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Co- ordination of Rural Advances and Agricultural Bank Act Amendment Act 1969. (2) The Co-ordination of Rural Advances and Agricultural Bank Act of 1938 as subsequently amended from time to time is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Co-ordination of Rural Advances and Agricultural Bank Act 1938-1969. 2. Amendment of s. 3 . Section 3 of the Principal Act is amended- (a) by omitting the definition " Agricultural Bank " or " Bank " and inserting in its stead the following definition: " " Agricultural Bank " or " Bank "-The Corporation constituted. by this Act, being such Corporation as constituted by the Minister for Primary Industries in office at the passing of the Co-ordination of Rural Advances and Agricultural Bank Act Amendment Act 1969 and his successors n office as Minister for Primary Industries in perpetual succession; "; and (b) by omitting, in the definition " Minister ", the word " Treasurer " and inserting in its stead the words " Minister for Primary Industries ".
90 Co-ordination of Rural Advances, Etc., Act Amdt Act 1969, No. 17 3. Amendment of s. 6 . Section 6 of the Principal Act is amended by omitting subsection (2) and inserting in its stead the following subsection:- ,, (2) Members. The Board shall consist of three members appointed by the Governor in Council. The General Manager of the Bank shall be one member of the Board and chairman thereof and the remaining two members shall be so appointed to represent the Department of Primary Industries and the Land Administration Commission respectively. The members of the Board other than the General Manager shall hold office at the pleasure of the Governor in Council. A member may hold his office as such in conjunction with any other office held by him under the Public Service Act19221968. The Governor in Council shall appoint one of the members of the Board other than the General Manager to be the deputy chairman of the Board.". 4. Preservation , etc., of the Bank . The Corporation of the Agricultural Bank is preserved and continued in existence in all respects and for all purposes notwithstanding the amendments to the Principal Act contained in section 2 of this Act, and the constitution in office, on and from the date of the passing of this Act, of the Minister for Primary Industries in lieu of the Treasurer as the said Corporation shall not affect the continuity of the identity or any rights or obligations of the said Corporation, or render defective any legal proceedings by or against the said Corporation, and any legal proceedings that might have been commenced or continued by or against such Corporation as constituted by the Treasurer may be commenced or continued by or against it as constituted by the Minister for Primary Industries. 5. Repeal of s. 7 (2) of No. 40 of 1943. Subsection (2) of section 7 of The Co-ordination of Rural Advances and Agricultural Bank Act Amendment Act of 1943 is repealed.
