COOMEALLA IRRIGATION AREA
DEEP DRAINAGE ACT.
Act No. 3, 1939.
An Act to sanction and to provide for the con- struction of a deep drainage system within the Coomealla Irrigation Area on the Murray River a few miles east of the town of Went- worth; to amend the Public Works Act, 1912, in certain respects; and for purposes connected therewith. [Assented to, 3rd June, 1939.]
BE it enacted by the King's Most Excellent Majesty, lative Council end Legislative Assembly of New South by and with the advice and consent of the Legis- Wales in Parliament assembled, end by the authority of the same, as follows :— 1 . This Act may be cited as the "Coomealla Irrigation Area Deep Drainage Act, 1939."
"2. This Act shall be deemed to have come into force
on the twentieth day of February, one thousand nine
hundred and thirty-seven.
3. (1) (a) The carrying out of the work described in the Schedule to this Act is hereby sanctioned.
(b) The said work shall be deemed to be an authorised work within the meaning of the Public Works Act, 1912, as amended by subsequent Acts.
(c) The Water Conservation and Irrigation Commission is empowered to carry out the said work, and shall be the constructing authority for the same within the meaning of the said Act, as so amended, and shall enter into such contracts and take all such necessary steps for the proper execution thereof as such authority may think proper.
(d) The provisions of the Public Works Act, 1912, as amended by subsequent Acts, sections thirty-four, thirty-five, thirty-six and thirty-seven excepted, shall apply to and in respect of the said work.
(2) Without prejudice to the generality of sub section one of this section the provisions of section thirty- eight of the Public Works Act, 1912, as amended by subsequent Acts, shall apply to and in respect of any contracts referred to in paragraph (c) of subsection one of this section.
4. The cost of carrying out the said work is estimated at sixty-one thousand pounds, and such estimated cost shall not, under any circumstances, be exceeded by more than ten per centum.
| 5. For the purposes of this Act, but not otherwise, the following amendments and additions shall be made in the |
Public Works Act, 1912, that is to say:—
(a)
Section ninety-eight is amended by inserting in subsection three before the words "public works" the words "authorised works o r " ;
(b)
Section one hundred and twenty-six is amended by inserting at the end of subsection two the following proviso:—
Provided that such interest shall not be paid
for any period during which delay in fixing the
amount of compensation or in completing titlehas
has been caused without reasonable excuse by the act or default of the person to whom such compensation is payable.
SCHEDULE.
A deep drainage system serving- an area of 2,015 acres within the Coomealla Irrigation Area on the Murray River a few miles east of the town of Wentworth, comprising:—
(a) Approximately 54 miies of high level gravity main pipe line;
(b)
Approximately 1J miles of low level main pipe line with pumping plant to force drainage water into so much of the work as is descrihed in paragraph (c) of this Schedule;
(c)
Approximately 1| miles of open channel conveying drainage water into Tucker's Creek, whence it flows to the Murray River;
(d) Approximately ISA miles of reticulation drains;
(e) Provision for later extension of so much of the work as is described in paragraphs (a) and (d) of this Schedule to serve, ultimately, an additional area of ."12 acres, and (f) Reinforced concrete inlet structure, culvert, silt pits and other minor works incidental to the construction, operation and maintenance of the scheme.
