CONVEYANCING ACT 1919—REGULATION

(Regulating the use of land held by the Defence Housing Authority)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Conveyancing Act 1919, has been pleased to make the Regulation set forth hereunder.

The Conveyancing Act Regulations 1961 are amended by inserting

after Regulation 87 the following Regulation:

Prescribed authority

87A. For the purposes of section 88D of the Act, the Defence Housing Authority established by the Defence Housing Authority Act 1987 of the Commonwealth is a prescribed authority.

EXPLANATORY NOTE

Section 88D of the Conveyancing Act 1919 empowers a “prescribed authority” to impose restrictions on the use of, or impose public positive covenants on, land vested in the authority.

The object of this Regulation is to amend the Conveyancing Act Regulations

1961 so as to prescribe the Defence Housing Authority as such an authority.
