His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Conveyancing Act 1919.

Explanatory note

The object of this Regulation is to include a proposal for re-alignment, widening or siting, or alteration of the level, of a road or railway by Rail Access Corporation as an adverse affectation for the purposes of Schedule 3 (Prescribed warranties) of the Conveyancing (Sale of Land) Regulation

1995.

This Regulation is made under the Conveyancing Act 1919, including section 52A (Contracts for sale of land).

1 Name of Regulation

This Regulation is the Conveyancing (Sale of Land) Amendment

(Rail Access Corporation) Regulation 1996.

2 Commencement

This Regulation commences on 26 July 1996.

3 Amendment of Conveyancing (Sale of Land) Regulation 1995

The Conveyancing (Sale of Land) Regulation 1995 is amended as set out in Schedule 1.

4 Notes

The explanatory note does not form part of this Regulation.

Schedule 1 Amendment of Conveyancing (Sale of
Land) Regulation 1995
(Clause 3)

Schedule 3 Prescribed warranties

Omit “or the State Rail Authority” from clause 1 of Part 3 of
Schedule 3.
Insert instead “, the State Rail Authority or Rail Access
Corporation”.
