His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Conveyancing Act 1919.

Explanatory note

The objects of this Regulation are:

(a)

to replace references to the Strata Titles Act 1973 and the Strata Titles (Leasehold) Act 1986 with references to the Strata Schemes (Freehold Development) Act 1973 and the Strata Schemes (Leasehold Development) Act 1986 respectively as a consequence of the re-naming of the former Acts by the Strata Schemes Management (Miscellaneous Amendments) Act 1996 (Schedule 1 [1] and [2]), and

(b)

to amend the definition of upgrading or demolition order in Parts 1 and 2 of Schedule 3 to include a reference to paragraph (d) of order No 2 in the Table to section 121B of the Environmental Planning and Assessment Act 1979 inserted in that Table by the Statute Law (Miscellaneous Provisions) Act (No 2) 1998 (Schedule 1 [3] and [4]), and

Explanatory note

(c) to replace references to the Electricity Transmission Authority and the Electricity Act 1945 with references to TransGrid and the Energy Services Corporations Act 1995 as a consequence of the corporatisation of the Electricity Transmission Authority by the Energy Services Corporations Amendment (TransGrid Corporatisation) Act 1998 (Schedule 1 [5]), and
(d) to remove a reference to Sydney Electricity as a consequence of its dissolution by the Electricity Supply Act 1995 (Schedule 1 [5]), and
(e) to replace a reference to a conservation instrument under the Heritage Act 1977 with a reference to an interim heritage order or listing on the State Heritage Register as a consequence of amendments made by the Heritage Amendment Act 1998 (Schedule 1 [6]), and
(f) to remove a reference to section 35 of the Environmentally Hazardous Chemicals Act 1985 as a consequence of the repeal of that section by the Contaminated Land Management Act 1997 (Schedule 1 [7]).

This Regulation is made under the Conveyancing Act 1919, including section 52A (2) (b), 66ZA (1) and 202 (the general regulation-making power).

1 Name of Regulation

This Regulation is the Conveyancing (Sale of Land) Amendment
(Law Revision) Regulation 1999.

2 Amendment of Conveyancing (Sale of Land) Regulation 1995

The Conveyancing (Sale of Land) Regulation 1995 is amended as set out in Schedule 1.

Omit ‘‘Strata Titles Act 1973’’ wherever occurring from items 5, 7, 8
and 15.
Insert instead ‘‘Strata Schemes (Freehold Development) Act 1973’’.

    Omit ‘‘Strata Titles (Leasehold) Act 1986’’ wherever occurring from items 6, 7 and 8 of Schedule 1, item 11 of Part 3 of Schedule 3 and item 2 (d) of Schedule 5.

    Insert instead ‘‘Strata Schemes (Leasehold Development) Act 1986’’.

  2. Schedule 3 Prescribed warranties

Omit ‘‘paragraph (a)’’ from item 2 (d) (i) of Part 1.
