Conveyancers Licensing Amendment

(Qualifications) Order 2012

Conveyancers Licensing Act 2003

I, Anthony John Roberts MP, the Minister for Fair Trading, in pursuance of section 9
of the Conveyancers Licensing Act 2003, make the following Order.

Explanatory note
The object of this Order is to add the Advanced Diploma in Conveyancing FNS60311 to the list of educational qualifications required for the issue of a licence to conduct a conveyancing business under the Conveyancers Licensing Act 2003. The diploma replaces the Advanced Diploma of Conveyancing FNS60310. The qualification has a new name and identifying code and some of the 18 units of competency currently required to obtain the qualification have been reclassified from core to elective units or from elective to core units.

This Order is made under section 9 of the Conveyancers Licensing Act 2003.

This Order is the Conveyancers Licensing Amendment (Qualifications)
Order 2012.

2      Commencement

This Order commences on the day on which it is published on the NSW legislation website.

Schedule 1 Qualifications for licence

Insert after the matter relating to Advanced Diploma of

Conveyancing FNS60310:

Advanced Diploma in Conveyancing FNS60311, which includes all of the Nil
following:
(a)  the following core units of competency:
(i)  BSBLEG415A Apply the principles of contract law
(ii)  FNSINC401A Apply principles of professional practice to work in the financial services industry
(iii)  FNSCNV501A Take instructions in relation to a transaction
(iv)  FNSCNV502A Read and interpret a legal document and provide advice
(v)  FNSCNV503A Analyse and interpret legal requirements for a transaction
(vi)  FNSCNV601A Identify and conduct searches
(vii)  FNSCNV504A Prepare legal documents
(viii)  FNSCNV505A Finalise the conveyancing transaction
(ix)  FNSCNV506A Establish and manage a trust account
(b)  the following elective units of competency:
