| veyancing," it is enacted by the fourteenth section thereof that every | |
| person, except a barrister or attorney and solicitor of the Supreme Court, who should be desirous of practising as a conveyancer should after examination and otherwise as therein prescribed be entitled to a | |
| certificate from the Master in Equity of the said Court authorising | |
| him so to practice : And whereas by a certain Act of the Governor and | |
| Legislative Council of New South Wales and amending Acts passed | |
| respectively in the twenty-sixth, thirty-sixth, and forty-first years of the reign of Her said Majesty QuBen Victoria, intituled " An Act for | |
| the Declaration of Titles to Land and to facilitate its transfer" cer | |
| tain provisions are made to facilitate the transfer of real property, and certain powers are conferred upon the Registrar-General appointed to carry out the same : And whereas the said above last-mentioned Act contains no provision whatever empowering or enabling conveyancers as officers of the Supreme Court to certify to, accept, or attest any document relating to the transfer, mortgage, lease, or other dealing with land under the " E-eal Property Act": And whereas great hardship being experienced by conveyancers and inconvenience occasioned to the public by the omission of such provisions it has been deemed expedient to amend the said Real Property and amending Acts : Be it there | |
| fore enacted by the Queen's Most Excellent Majesty, by and with the | |
| advice and consent of the Legislative Council and Legislative Assembly | |
| of New South Wales in Parliament assembled, and by the authority of | |
| the same, as follows :— |
1. That conveyancers are hereby empowered to certify to,
accept, attest, and otherwise perform all of the acts necessary for the
due completion of any transfer, mortgage, lease;, application, cweat, and any other document of whatsoever nature or kind relating to dealings under the " Peal Property Act," and to give receipts to the Pegistrar-General for any such document on the completion of such document, and the Registrar-General is hereby authorised to accept
the certificate and acceptance and attestation and other acts of
conveyancers relating to any dealing under the said " Real Property
Ac t" and amending Acts, and to accept the receipt of any conveyancer for any document received by him on behalf of any person or persons,
and to accept the acts of such conveyancers in every respect and to
ilic same extent as the Registrar-General is now entitled to accept the
acts, certificates, attestations, acceptances, and receipts of solicitor*.
