Part 1—Preliminary

1—Short title

These regulations may be cited as the Controlled Substances (Poisons) (Packaging and Labelling) Variation Regulations 2019.

2—Commencement

These regulations come into operation on the day on which they are made.

3—Variation provisions

In these regulations, a provision under a heading referring to the variation of specified regulations varies the regulations so specified.

4—Variation of regulation 26—Packaging and labelling of poisons (section 24 of Act)

  1. Regulation 26(1)(b)(iv)—delete "Therapeutic Goods Order No 80" and substitute:

    Therapeutic Goods Order No 95

  2. Regulation 26(6)—delete "Therapeutic Goods Order No 80" and substitute:

    Therapeutic Goods Order No 95

  3. Regulation 26(8)—delete "Therapeutic Goods Order No 80" and substitute:

    Therapeutic Goods Order No 95

  4. Regulation 26(9), definition of prescribed medicine—delete "Therapeutic Goods Order No 80" wherever occurring and substitute in each case:

    Therapeutic Goods Order No 95

  5. Regulation 26(9), definition of prescribed S3 poison, (b) and (c)—delete paragraphs (b) and (c)

  6. Regulation 26(9), definition of Therapeutic Goods Order No 80—delete the definition and substitute:

    Therapeutic Goods Order No 95 means Therapeutic Goods Order No. 95 - Child‑resistant packaging requirements for medicines 2017 made under the Commonwealth Act on 29 November 2017, as in force from time to time.

As required by section 10AA(2) of the Subordinate Legislation Act 1978, the Minister has certified that, in the Minister's opinion, it is necessary or appropriate that these regulations come into operation as set out in these regulations.
