Controlled Substances (Miscellaneous) Amendment Act 2016

An Act to amend the Controlled Substances Act 1984.

The Parliament of South Australia enacts as follows:

Part 1Preliminary1Short title

This Act may be cited as the Controlled Substances (Miscellaneous) Amendment Act 2016.

2Commencement

This Act will come into operation on a day to be fixed by proclamation.

3Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2Amendment of Controlled Substances Act 19844Amendment of section 16 – Sale of certain poisons

Section 16(4)—delete subsection (4) and substitute:

  1. (4)

    A person who sells poisons to which this section applies must keep prescribed records.

Maximum penalty: $10 000.

5Amendment of section 18 – Regulation of prescription drugs

Section 18(1d)(c) and (d)—delete paragraphs (c) and (d) and substitute:

  1. (c)

    a person may administer a prescription drug (not being a drug of dependence) to another person if—

    1. (i)

      the person is licensed to do so by the Minister; or

    2. (ii)

      the drug has been lawfully prescribed for, or supplied to, that other person;

  2. (d)

    a person may administer a prescription drug (not being a drug of dependence) to an animal if—

    1. (i)

      the person is licensed to do so by the Minister; or

    2. (ii)

      the drug has been lawfully prescribed or supplied for that animal.

6Amendment of section 57 – Power of Minister to prohibit certain activities

Section 57(1)(c)—after "prescribed," insert:
