Citation

1. These regulations may be cited as the Controlled Substances (Declared Prescription

Drugs) Regulations 1992.

Revocation

2. The Controlled Substances (Declared Prescription Drugs) Regulations 1985 (see Gazette

9 May 1985 p. 1481), as varied, are revoked.

Interpretation

3. In these regulations—

"the Act" means the Controlled Substances Act 1984:

"poison" means a substance declared to be a poison by the Controlled Substances (Declared

Poisons) Regulations 1991 (the "Poisons Regulations") and includes—

(a)

the natural or synthetic form of such a poison;

(b)

any salt, active principle, alkaloid, derivative, stereoisomer, ester, or ether of the natural or synthetic form of such a poison;

(c)

any of the poisons referred to in paragraphs (a) and (b) whether existing alone or in any preparation, admixture, solution or natural substance:

"schedule 4 poison" means a substance, from time to time, declared by the Poisons

Regulations to be a schedule 4 poison:

"schedule 8 poison" means a substance, from time to time,declared by the Poisons

Regulations to be a schedule 8 poison.

Declaration of prescription drugs

4. For the purposes of section 12(2) of the Act, each of the schedule 4 and schedule 8

poisons is declared to be a prescription drug.
