Citation

1. These regulations may be cited as the Controlled Substances (Declared Drugs of

Dependence) Regulations 1993.

Commencement

2. These regulations come into operation on the day on which they are made.

Revocation

3. The Controlled Substances (Declared Drugs of Dependence) Regulations 1985 (see

Gazette 9 May 1985 p. 1485), as varied, are revoked.

Interpretation

4. In these regulations, unless the contrary intention appears—

"the Act" means the Controlled Substances Act 1984.

Poisons declared to be drugs of dependence

5. Pursuant to section 12(3) of the Act, each of the following poisons is declared to be a

drug of dependence:

(a)

a poison listed in schedule 8 of the Standard for the Uniform Scheduling of Drugs and Poisons as modified and adopted by the Controlled Substances (Poisons) Regulations 1991 (see Gazette 24 January 1991 p. 238); and

(b)

—

(i)	the natural or artificial form of such poison;
(ii)	where such poison is a plant—that plant or any part of that plant;
(iii)	every salt, active principle or derivative of such poison and every salt of such an active principle or derivative;
(iv)	every alkaloid of such poison and every salt of such alkaloid;
(v)	except where such poison is levomethorphan or levorphanol, every stereoisomer of the poison and every salt of such stereoisomer;
(vi)	a preparation or admixture containing any proportion of such poison;
(vii)	any ester or ether of such poison and every salt of such an ester or ether.

Prescribed amounts (s. 32(3))

6. For the purposes of section 32(3) of the Act, the prescribed amount of a drug of dependence is the amount listed in Schedule 1 opposite the entry listing the class of the drug of dependence.

Prescribed amounts (s. 32(5)A(2)(b)(i))

7. For the purposes of section 32(5)A(2)(b)(i) of the Act, the prescribed amount of a drug of dependence is the amount listed in Schedule 2 opposite the entry listing the class of the drug of dependence.
