Control of Weapons Amendment (Penalties) Act 2007

The Parliament of Victoria enacts:
1Purpose
The purpose of this Act is to amend the Control of Weapons Act 1990 to increase the penalties for offences under sections 5(1) and 6(1) of that Act.
2Commencement
(1)Subject to subsection (2), this Act comes into operation on a day to be proclaimed.
(2)If this Act does not come into operation before 1 July 2007, it comes into operation on that day.
3New penalty for section 5(1) (prohibited weapons)
For the penalty at the foot of section 5(1) of the Control of Weapons Act 1990 substitute—
"Penalty:240 penalty units or imprisonment for 2 years.".
4New penalty for section 6(1) (controlled weapons)
For the penalty at the foot of section 6(1) of the Control of Weapons Act 1990 substitute—
"Penalty:120 penalty units or imprisonment for 1 year.".
5Repeal of Act
This Act is repealed on 1 July 2008.
