An Act to amend the Control of Vehicles (Off‑road Areas) Act 1978.

[Assented to 22 August 2025]

The Parliament of Western Australia enacts as follows:

1.Short title

This is the Control of Vehicles (Off‑road Areas) Amendment Act 2025.

2.Commencement

This Act comes into operation as follows —

  • (a)

    sections 1 and 2 — on the day on which this Act receives the Royal Assent (assent day);

  • (b)

    sections 3, 5(4), 7(2), 9 to 12, 14 and 15 — on the day after assent day;

  • (c)

    the rest of the Act — on a day fixed by proclamation.

3.Act amended

This Act amends the Control of Vehicles (Off‑road Areas) Act 1978.

4.Section 28A amended

    The amount of a modified penalty prescribed under subsection (10) for an offence must not exceed 10% of the penalty specified for the offence by this Act or a regulation or local law made under this Act.

50. Transitional provision for Control of Vehicles (Off‑road Areas) Amendment Act 2025

An amendment made to section 29A(1)(a) or (2) by the Control of Vehicles (Off‑road Areas) Amendment Act 2025 does not apply to a person who has given notice in writing under that provision before the commencement of the amendment.
