CONTROL OF VEHICLES (OFF-ROAD

AREAS) AMENDMENT ACT

No. 56 of 1986

AN ACT to amend the Control of Vehicles (Off-road areas) Act

1978.

[Assented to 26 November 1986.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

Short title

1. This Act may be cited as the Control of Vehicles (Off-road areas)

Amendment Act 1986.

Commencement

2. This Act shall come into operation on such day as is fixed by

proclamation.

Principal Act

3. In this Act the Control of Vehicles (Off-road areas) Act 1978* is

referred to as the principal Act.

1984 and 12 of 1985.]

Section 21 amended

4. Section 21 of the principal Act is amended

(a) in subsection (1)-

(i) by deleting "five" and substituting the following-

7  "

(ii) by deleting "and" after paragraph (c);

(iii) by deleting the comma at the end of paragraph (d) and substituting a semi-colon; and

(iv) by inserting after paragraph (d) the following "

paragraphs

(e) one shall be a person selected from amongst persons who have in the opinion of the Minister appropriate experience in the operation of four- wheel drive vehicles; and

"

(f) one shall be a person nominated by the Minister to whom the administration of the Conservation

and Land Management Act 1984 is for the time

being committed by the Governor, being a person who in the opinion of that Minister has appropriate experience in environmental matters, "; and

(b) in subsection (5) by deleting "three" and substituting the following

" 4 ".

Section 24 amended

5. Section 24 of the principal Act is amended in subsection (3) by deleting "paragraph (b) and paragraph (c) of subsection (1) of section 21" and substituting the following-

" section 21 (1) (b), (c), (d), (e) and (f) ".
