STATUTORY RULES.

1927. No. 109.

REGULATIONS UNDER DEFENCE ACT 1903-1927.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the DefenceAct 1903-1927 to come into operation forthwith.

Control of Defence Areas Regulations.

Short title.

1. These Regulations may be cited as the Control of Defence Areas Regulations.

Definitions.

2. In these Regulations unless the contrary intention appears:—

“Defence Area” means an area proclaimed by the Governor-General to be an area in which the regulation, control or prohibition of the construction of buildings or other erections is necessary for the defence of the Commonwealth.

“The Schedule” means the schedule to these Regulations.

“The Minister” includes any person authorized in writing by the Minister to do or perform the act in respect of which the expression is made.

Building of oil or explosive stores.

3. Any person, who without the consent in writing of the Minister (proof whereof shall be upon that person) constructs, in any defence area specified in Table A of the Schedule any building or erection for the manufacture or storage of explosives, oil or other readily combustible material, shall be guilty of an offence.

Height of buildings.

4. (1) Any person who, without the consent in writing of the Minister (proof whereof shall be upon that person) constructs in any defence area specified in Table B of the Schedule any building or erection of a greater maximum height than fifty feet shall be guilty of an offence.

(2) Any person who, without the consent in writing of the Minister (proof whereof shall be upon that person) constructs in such parts as are specified in Table C of the Schedule, of defence areas specified in Table B of the Schedule, any building of a greater maximum height than fifteen feet shall be guilty of an offence.

Application for consent.

5. Any person who desires to construct a building or erection to which any of the last three preceding regulations applies may apply in writing to the Minister for consent to the construction, stating in his application the site, maximum height and purposes of the building or erection.

Further information.

6. Upon receipt of any application made under the last preceding regulation the Minister may require from the applicant such particulars and information as he thinks fit.

Applications how dealt with

7. The Minister may, in his absolute discretion, grant or refuse any application made under these Regulations or may grant any such application subject to such conditions as to construction, marking of the building or otherwise as he thinks fit.

Failure to comply with conditions.

8. Any person to whom consent has been granted under these Regulations to the construction by him of a building or erection subject to any condition as to construction marking or otherwise, who fails to comply with that condition shall be guilty of an offence.

No compensation payable.

9. (1) No person who is prevented by or under these Regulations from building in a defence area, shall have any action, claim or demand against the Commonwealth or any officer of the Commonwealth by reason of his being prevented from building.

(2) No person who has received consent under these Regulations to the construction in a defence area of a building or erection shall have any action, claim or demand against the Commonwealth or any officer of the Commonwealth by reason of any damage caused to that building or erection by the vicinity of defence works or by defence operations.

Penalties.

10. Any person who commits any offence against these Regulations shall be liable to a fine not exceeding Twenty pounds or to imprisonment for three months or to both fine and imprisonment.

Removal of buildings.

11. (1) Where any building or erection is constructed in a defence area in contravention of these Regulations or in the construction of which any condition attached to the consent of the Minister has not been observed, the Minister may by notice in writing require the owner of the building or erection to remove it within the time specified in the notice.

(2) Where any person to whom a notice under this regulation is directed, fails to comply with the requirements contained in the notice the Minister may cause the building or erection specified in the notice to be removed and the expense of that removal shall be borne by the person to whom the notice was directed and shall be recoverable as a debt due by him to the Crown.

TABLE A.

Regulation 3.

NORTH AUSTRALIA.

County of Palmerston.

Hundred of Bagot.

All that piece or parcel of land at Darwin in the Hundred of Bagot: Commencing at a point in the high-water mark of the Timor Sea at its intersection with the production westerly of the northern boundary of section 8; thence easterly by that production and that boundary; thence southerly by the eastern boundaries of sections 8, 7 and 1 and the latter boundary produced to its intersection with the high-water mark of Frances Bay; thence generally southerly, westerly, northerly and north-easterly by the high water marks of Frances Bay, Port Darwin, Fanny Bay and Timor Sea to the commencing point.

Hundred of Bray.

(a) All that piece or parcel of land at West Point: Commencing at a point in the high-water mark of Woods’s Inlet at its intersection with the production southerly of the western boundary of section 7; thence northerly by that production and that boundary and that boundary produced to the high-water mark of the Timor Sea; and thence generally south-easterly, southerly and south-westerly by the high-water marks of this Timor Sea and Woods’s Inlet to the commencing point.

(b) All that piece or parcel of land at Tale Head; Commencing at a point in the high-water mark of Port Darwin at its intersection with the production easterly of the northernmost boundary of section 10; thence southerly by that high-water mark to its intersection with a line due east and west passing through the westernmost corner of section 10; thence westerly by that line to its intersection with the high-water mark of Woods’s Inlet; thence north-easterly and southerly by the high water marks of Woods’s Inlet and Port Darwin to the commencing point.

QUEENSLAND.

County of Stanley.

Parish of Enoggera.

All that piece or parcel of land in the Parish of Enoggera, County of Stanley, being Reserve 985 for a Rifle Range at Enoggera and other lands adjoining: Commencing at a point on the southern side of the Samford-road being the northernmost corner of the said Reserve 985; thence generally easterly by the southern side of the Samford-road to the north-western corner of portion 416; thence generally southerly by the western boundary of portion 416, a line across a road, the western boundaries of portions 444 and 457, a line across Banks-street, the western and south-western boundaries of portion 463, a straight line from the southern corner of portion 463 to the north-eastern corner of Holmesbrook-street, the north-eastern side of Holmesbrook-street and the eastern side of Three Graham-street to the northern side of the Waterworks-road thence generally westerly by the northern side of the Waterworks-road to the eastern side of Orchard-street; thence northerly by the eastern side of Orchard-street and that side produced across the Enoggera Creek to the left bank of that creek; thence again westerly by the left bank of the Enoggera Creek to the south-western corner of portion 384; thence northerly by the western boundary of portion 384, a line across a road and the western boundary of portion 372 to a southern boundary of Reserve 985; thence westerly by that southern boundary of that reserve to the eastern side of the road which forms the western boundary of Reserve 985; thence generally north-westerly by the eastern side of that road; and thence generally north-easterly by the northern and north-western boundaries of Reserve 985 to the point of commencement.

County of Torres.

Parish of Mooralug.

All that piece or parcel of land in the Parish of Mooralug, County of Torres, being part of Prince of Wales Island, including Reserve No. 15 for Defence purposes, at Heath Point, bounded by lines parallel to and distant 40 chains from the south-eastern and south-western boundaries of Reserve 15 before mentioned and bounded on the seaward side by high-water mark of Torres Strait.

Parish of Port Kennedy.

All those pieces or parcels of land in the Parish of Port Kennedy, County of Torres, being Wednesday, Thursday, Friday, Goode, Hammond and Wai Weer Islands, and a strip of land 50 chains each side of the telegraph cable line running in a north-westerly direction across Horn Island.

County of Cook.

Parish of Barolin.

All that piece or parcel of land in the Parish of Barolin, County of Cook, being a Post and Telegraph Reserve, No. 151, part of Reserve 150, for Pasturage Reserve, and part of Reserve 654 for Public Park and portion 13: Commencing at a point on the high-water mark of the South Pacific Ocean being the south-eastern corner of portion 7; thence in a south-easterly direction by that high-water mark to a point below the production north-easterly of the north-western boundary of section 7, Nielson Park; thence south-westerly by that production, the north-western boundary of section 1 before mentioned, and that boundary produced south-westerly to a north-eastern side of the Woongarra branch railway; thence north-westerly by that side of that railway to the south-eastern boundary of portion 7, being also a north-western side of a road; thence north-easterly by that boundary and thence northerly and easterly by the north-eastern and a south-eastern boundary of portion 7 to the commencing point.

Town of Southport; thence north-easterly by the south-eastern side of Nerang-street and that side produced to the high-water mark of Broad Water; thence southerly by that high-water mark to a point being the production easterly of the southern side of Short-street: thence easterly across the mouth of the Nerang River to Nerang Point; thence southerly by the high-water mark of South Pacific Ocean to south-eastern corner of Reserve 305 for Public purposes; thence westerly by the southern boundary of that reserve and that boundary produced across the right arm of the Nerang River to east side of Great Sandy Island; thence south-westerly and northerly by eastern and western sides of that island to a point being the production easterly of the northern side of a road being the southern boundary of Portion 7; thence westerly by that production and that northern side to its intersection with the eastern side of a road being the continuation southerly of High-street before-mentioned; and thence northerly by that eastern side and the eastern side of High-street to the commencing point.

All that piece or parcel of land near Manly, containing an area of 658 acres, more or less, being the Manly quarantine area in the Parish of Manly Cove, County of Cumberland.

 

Parish of Alexandria.

(a) All that piece or parcel of land in the Parish of Alexandria, County of Cumberland: Commencing at the intersection of the southern side of Murriverie-street with the high-water mark of the South Pacific Ocean; thence westerly by the southern side of Murriverie-street; thence generally southerly by the eastern side of Military-road to its intersection with the eastern boundary of lot 1 of section 2 of a subdivision of portion 199, which is part of the eastern boundary of a piece of land numbered “4” on the map of the said parish; thence southerly by that eastern boundary and its production southerly to the high-water mark of Bondi Bay; thence southerly by that high-water mark; and thence generally northerly by the high-water mark of the South Pacific Ocean to the point of commencement.

(a) All that piece or parcel of land in the City and Parish of Newcastle, County of Northumberland: Commencing at the southernmost corner of a piece of land appropriated for tramway purposes 24th February, 1903; thence northerly by a straight line to the north-western corner of land dedicated for Defence purposes 29th June, 1894; thence northerly by the western boundary of that land and that boundary produced being a line bearing 7 degs. 9 mins. to the high-water mark of Port Hunter; thence north-easterly by the high-water mark of Port Hunter to the extremity of the southern breakwater; and thence south-westerly and southerly by the high-water mark of the South Pacific Ocean to its intersection with the production southerly of the line firstly herein-mentioned; and thence northerly by that production to the point of commencement.

Parish of Tomaree.

(а) All that piece or parcel of land in the Parish of Tomaree, County of Gloucester: Commencing on the high-water mark of Fingal Bay at its intersection with the production southerly of the western boundary of portion 173; thence northerly by that production that western boundary and the production northerly of that boundary to the high-water mark of Shoal Bay; thence northerly by the high-water mark of Shoal Bay; and thence generally southerly, easterly, and westerly by the high-water mark of the South Pacific Ocean and Fingal Bay to the point of commencement.

All that piece or parcel of land at North Fremantle: Commencing at the intersection of the north-western side of Lilburn-road with the south-eastern side of Clifton-street; thence north-easterly by the south-eastern side of Clifton-street; thence north-easterly by the south-eastern side of John-street to its intersection with the production south-easterly of the north-eastern side of Bayley-street; thence north-westerly by that production and that side of that street; thence north-easterly by the south-eastern side of Bayley-street and that side produced to the south-western side of Barker-street; thence north-westerly by that side of that street and that side produced to the high-water mark of the Indian Ocean; thence southerly by that high-water mark to its intersection with the production north-westerly of the south-western boundary of Reserve 11069; thence south-easterly by that production and that boundary to the southernmost corner of that reserve; and thence north-easterly by a straight line to the point of commencement.

North Fremantle.

All that piece or parcel of land at North Fremantle: Commencing on the high-water mark of the Indian Ocean at the north-westernmost point of Rous Head; thence easterly by that high-water mark 2 chains; thence south-easterly by a line bearing 150 degrees to the high-water mark of the Swan River; thence south-westerly and westerly by that high-water mark to the western extremity of the North Mole; and thence easterly and north-easterly by the high-water mark of the Indian Ocean to the point of commencement.

Fremantle.

All that piece or parcel of land at Fremantle; Commencing at the northern-most corner of Reserve 10517; thence by a straight line due south to the high-water mark of the Indian Ocean; thence westerly by that high-water mark to the western extremity of the South Mole; thence easterly; northerly and north-easterly by the high-water mark of the Swan River to a point due north of the northernmost corner of Reserve 10517 beforementioned; and thence due south by a straight line to the point of commencement.
