Citation

1. These Regulations may be cited as the Control of Defence Areas Regulations.*1*

CONTROL OF DEFENCE AREAS REGULATIONS - REG 2
Repeal

2. The Control of Defence Areas Regulations (being Statutory Rules 1927, No. 109, as amended by Statutory Rules 1929, No. 18 and 1932, No.7) are hereby repealed.

CONTROL OF DEFENCE AREAS REGULATIONS - REG 3
Interpretation

Amended by 1976 No. 29 r. 2 3. In these Regulations, unless the contrary intention appears-
"Defence area" means an area proclaimed by the Governor-General to be an area in which the regulation, control, or prohibition of the construction of buildings or other erections is necessary for the defence of Australia.

CONTROL OF DEFENCE AREAS REGULATIONS - REG 4
Delegation

4. (1) The Minister may, by writing under his hand, delegate to any person any of his powers or functions under these Regulations so that the delegated powers or functions may be exercised by the person with respect to the matters specified in the instrument of delegation.

(2) Every delegation under this regulation shall be revocable at will and no delegation shall prevent the exercise of any power or function by the Minister.

CONTROL OF DEFENCE AREAS REGULATIONS - REG 5
Proclamation of defence areas

Amended by 1976 No. 29 r. 2 5. The Governor-General may, by proclamation, declare any area to be an area in which the regulation, control or prohibition of the construction of buildings or other erections is necessary for the defence of Australia.

CONTROL OF DEFENCE AREAS REGULATIONS - REG 6
Building of oil or explosive stores

6. Any person who, without the consent in writing of the Minister (proof whereof shall be upon that person), constructs in any defence area specified in Table I of the Schedule any building or erection for the manufacture or storage of explosives, oil or other readily combustible material, shall be guilty of an offence.

CONTROL OF DEFENCE AREAS REGULATIONS - REG 7
Height of buildings

Amended by 1976 No. 29 r. 2 7. Any person who, without the consent in writing of the Minister (proof whereof shall be upon that person), constructs-
(a) in any defence area specified in Table II of the Schedule-any building or erection of a greater maximum height than 5 metres;
(b) in any defence area specified in Table III of the Schedule-any building or erection of a greater maximum height than 15 metres; or
(c) in any defence area specified in Table IV of the Schedule-any building or erection of a greater maximum height than 30 metres,
shall be guilty of an offence.

CONTROL OF DEFENCE AREAS REGULATIONS - REG 8
Applications for consent

Amended by 1976 No. 29 r. 2 8. Any person who desires to construct a building or erection to which either regulation 6 or regulation 7 applies may apply in writing to the Minister for consent to the construction, stating in his application the site, maximum height and purposes of the building or erection.

Minister may require further information

Amended by 1976 No. 29 r. 2 9. Upon receipt of any application made under regulation 8 the Minister may require from the applicant such particulars and information as he thinks fit.

CONTROL OF DEFENCE AREAS REGULATIONS - REG 10
Application, how dealt with

10. The Minister may, in his absolute discretion, grant or refuse any application made under these Regulations or may grant any such application subject to such conditions as to construction, marking of the building or otherwise as he thinks fit.

CONTROL OF DEFENCE AREAS REGULATIONS - REG 11
Failure to comply with conditions

11. Any person to whom consent has been granted under these Regulations to the construction by him of a building or erection subject to any condition as to construction, marking or otherwise, who fails to comply with that condition shall be guilty of an offence.

CONTROL OF DEFENCE AREAS REGULATIONS - REG 12
No compensation payable

Sub-reg. (1) amended by 1976 No. 29 r. 2 12. (1) No person who is prevented by or under these Regulations from building in a defence area shall have any action or claim, or make any demand, against Australia or any officer of Australia by reason of his being prevented from building.

Amended by 1976 No. 29 r. 2 (2) No person who has received consent under these Regulations to the construction in a defence area of a building or erection shall have any action or claim, or make any demand, against Australia or any officer of Australia by reason of any damage caused to that building or erection by the vicinity of defence works or by defence operations.

CONTROL OF DEFENCE AREAS REGULATIONS - REG 13
Penalties

Amended by 1976 No. 29 r. 2 13. Any person who commits any offence against these Regulations shall be liable to a fine not exceeding $40 or to imprisonment for 3 months.

CONTROL OF DEFENCE AREAS REGULATIONS - REG 14
Removal of buildings

14. (1) Where any building or erection is constructed in a defence area in contravention of these Regulations or in the construction of which any condition attached to the consent of the Minister has not been observed, the Minister may by notice in writing require the owner of the building or erection to remove it within the time specified in the notice.

(2) Where any person to whom a notice under this Regulation is directed fails to comply with any requirement contained in the notice, the Minister may cause the building or erection specified in the notice to be removed and the expense of that removal shall be borne by the person to whom the notice was directed and shall be recoverable as debt due by him to the Crown.
