TRACTORS' AND [ASSENTED TO 31sT OOTOBER, 1921.] WORKMEN'S LIEN ACT BE it enacted by the King's Most Excellent Majesty, ! : ~ ~ ~ ~ ~ r by and with the advice and consent of the Legis- lative Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- Short title, 1. (1.) This Act may be cited as "The Oontractors' construction, and Workmen's Lien Act Amendment Act of 1921," and : ; ~ Iication shall be read as one with *" The Oontractors' and Workrrten' 8 of Act. Lien Act of 1906," herein referred to as the Principal Act. That Act and this Act may together be cited as "The Oontractors' and Workmen's Lien Acts, 1906 to 1921." (2.) Nothing in this Act shall apply to contracts which have been entered into before the passing of this Act. Amendmont 2. The following amendments are made in section of s. 2. two of the Principal Act:- (i.) The following words are added to the definition of " Employer" :-" and in relation to a sub-contractor includes the contractor with and under whom he has contracted and any other sub-contractor with and under whom he has contracted." (ii.) After the definition of "Owner" the following definition is inserted:- . "Sub-contractor"-A person who enters into a contract with a contractor for the perform- ance of any part of the work and also the supply of any part of the mq,terials that would * 6 Edw. VII. Contractor8' and Workmen'8 Lien Act. require to be performed and supplied by the contractor but for such contract: the term includes a person who enters into a contract with a sub-contractor for the performance of any part of the work and also for the supply of any part of the materials that would require to be performed and supplied by such sub-contractor but for such last-mentioned contract." (iii.) In the definition of " Workman," after the word "contractor" the words "or sub-contractor" are inserted. 3. In. section four of the Principal Act, after the Amendment. word" contractor" wherever it therein occurs the words of s. 4. "or sub-contractor" are inserted. 4. In section six of the Principal Act, after the Amendment word "contractor" the words "or sub-contractor" are of s. 6. inserted; after the word "employed" the words "and a sub-contractor is entitled to a charge for the money due to him under his contract upon any money payable to the contractor or sub-contractor with and under whom he has contracted" are added; and after the word "workman" where it secondly occurs the words " or sub-contractor" are inserted. . 5. In section eight of the Principal Act, the words Amendment "(b) The liens of contractors" are repealed and the of s. 8. words- "(b) The liens of sub-contractors who have con- tracted with and under sub-contractors; (c) The liens of sub-contractors who have con- tracted with and under contractors; (d) The liens of contractors." are inserted in lieu thereof; also, the word "two" is repealed and the word "four" is inserted in lieu thereof. 6. In section sixteen of the Principal Act, the of s. 16. words "for wages" are repealed and the words "sub- contractors or contractors" are inserted in lieu thereof. Amendment 9. In section twenty-two of the Principal Act, after of s. 22. the word "contractor" wherever it occurs the words "or sub-contractor" are inserted. Amendment 10. In section twenty-six of the Principal Act, the of s. 26. words "an employer or contractor to any" are repealed and the words " any person to any other" are inserted in lieu thereof. Amendmelll 11. In section forty-six of the Principal Act, after of s. 4(). the word "contractor" the word "sub-contractor" is inserted. AppJicatio:J 12.
