20 Quanolan4 ANNO VICESIMO SECUNDO ELIZABETHAE SECUNDAE REGI N AE No0 4 of 1973 An Act to amend the ConstructionSafetyAct 1971 in certain particulars [ASSENTED TO 11TH APRIL, 1973] BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title and citation . (1) This Act may be cited as the Construction Safety Act Amendment Act 1973. (2) The Construction Safety Act 1971 is in this Act referred to as the Principal Act. (3) The Principal Act as amended by this Act may be cited as the Construction Safety Act1971-1973. 2. Amendment of s. 6. Section 6 of the Principal Act is amended by omitting the definition constructor " and inserting in its stead the following definition:- " " constructor " means a person who makes a contract with the owner of a project to perform otherwise than as a servant construction work involved in the project or, where in respect of a project- (a) more than one such contract is made with the owner; or (b) the owner undertakes construction work as an employer, means the owner of the project; ".
Construction Safety Act Amendment Act 1973, No. 4 21 3. Repeal of and new s. 38 . The Principal Act is amended by repealing section 38 and inserting in its stead the following section:- " 38. Notifiable work to be notified before commencement. A constructor shall not commence nor cause nor suffer to be commenced any construction work that is notifiable work unless he has first notified the Chief Inspector, as. prescribed, of the nature of the work and of the time when that work is to be commenced.". 4. New s. 78. The Principal Act is amended by inserting after section 77 the following section:- 1178. Power to delegate. (1) The Chief Inspector may either generally or otherwise as provided by the instrument of delegation, by writing signed by him, delegate to any person all or any of his powers, functions and duties except this power of delegation. (2) A power, function or duty so delegated, if exercised or performed by the delegate, shall be exercised or performed in accordance with the instrument of delegation. (3) A delegation may be made subject to such terms and limitations as the Chief Inspector thinks fit including a requirement that the delegate shall report to the Chief Inspector upon his exercise or performance of the delegated power, function or duty. (4) The Chief Inspector may make such and so many delegations of the same power, function or duty and to such number of persons as he considers necessary or desirable. (5) A delegation is revocable at the will of the Chief Inspector and does not prevent the exercise of a power or the performance of a function or duty by him.".
