CONSTRUCTION SAFETY ACT 1912—REGULATION
(Relating to the use of explosives in building, excavation and compressed
air work)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Construction Safety Act 1912, has been pleased to make the Regulation set forth hereunder.

Commencement
1. This Regulation commences on 1 August 1994.
Amendments
2. The Construction Safety Regulations 1950 are amended:
(a) by omitting Part 9 and by inserting instead the following Part:
PART 9—USE OF EXPLOSIVES
Use of explosives
102. (1) The use of explosives in building work, excavation work and compressed air work must be carried out in accordance with Australian Standard AS 2187.2—1993 (Part 2: Use of Explosives) as in force on 1 August 1994.
(2) In this clause, “explosive” means any substance (or mixture of substances) which, when initiated by any heat source, shock or other means, decomposes to produce heat, light, noise and gas for a practical effect, and includes:

(a)
detonators, fuses and blasting accessories containing any such substance or mixture of substances; and
(b)
any items specified as Class 1 Dangerous Goods in the Australian Code for the Transport of Dangerous Goods by Rail and Road as in force on 1 August 1994.
(b) by omitting the Sixth Schedule.
EXPLANATORY NOTE
The object of this Regulation is to replace the existing provisions of the Construction Safety Regulations 1950 relating to the use of explosives in building, excavation and compressed air work with the requirement that the use of explosives in such work must comply with the relevant Australian Standard.
This Regulation is made under section 22 (the general regulation—making power) of
the Construction Safety Act 1912.
