CONSTRUCTION SAFETY ACT 1912—REGULATION

(Relating to the update of Australian Standards and to the supply of

earthmoving machines)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Construction Safety Act 1912, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 8 August 1991.

Amendments

2. The Construction Safety Regulations 1950 are amended.

(a)

by omitting from Regulation 99 the words “Australian Standard entitled ‘UNDERWATER AIR BREATHING OPERATIONS’ published in 1979 by the Standards Association of Australia as AS 2299–1979 (inclusive only of Amendment No. 1 published by that Association on 6 December 1982)” and by inserting instead the words “Australian Standard AS 2299–1990 (Occupational

Diving) published by Standards Australia as in force at 14 May
1990”;

(b)

by omitting from Regulation 121D (1) (a) the words “AS 1755–1975 published by the Standards Association of Australia and entitled ‘Safe Operation of Conveyors’ (known as the S.A.A. Conveyor Safety Code) as in force on 1st July 1982” and by

inserting instead the words “AS 1755–1986 (Conveyors—Design, Construction, Installation, and Operation—Safety Requirements) published by the Standards Association of Australia as in force at 3 March 1986”;

(c)

by omitting from Regulation 121D (2) the matter “AS 1755–1975” and by inserting instead the matter “AS 1755–1986”;

(d)

by omitting from Regulation 134A (2) the words “Paragraphs (3)–(8)” and by inserting instead the words “Paragraphs (3)–(7)”.

EXPLANATORY NOTE

The object of this Regulation is to mend the Construction Safety Regulations

1950:

(a) by updating the references to certain Australian Standards; and

(b) by providing that the safety provisions of Regulation 134A (8) are to apply to all earthmoving machines and not just to those more recently manufactured types of machines referred to in Regulation 134A (2).
